- Acupuncture: means the practice of acupuncture as defined in Section
58-72-102 . See Utah Code 58-71-102 - Adjudicative proceeding: means :(2)(a) an action by a board, commission, department, officer, or other administrative unit of the state that determines the legal rights, duties, privileges, immunities, or other legal interests of one or more identifiable persons, including an action to grant, deny, revoke, suspend, modify, annul, withdraw, or amend an authority, right, or license; and(2)(b) judicial review of an action described in Subsection (2)(a). See Utah Code 68-3-12.5
- Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Adult: means an individual who is at least 18 years old. See Utah Code 26B-8-301
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Agent: means an individual:
(2)(a) authorized to make health care decisions on the principal's behalf by a power of attorney for health care; or(2)(b) expressly authorized to make an anatomical gift on the principal's behalf by any other record signed by the principal. See Utah Code 26B-8-301- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Anatomical gift: means a donation of all or part of a human body to take effect after the donor's death for the purpose of transplantation, therapy, research, or education. See Utah Code 26B-8-301
- Anesthesiologist: means an individual who:
(1)(a) is licensed under Chapter 67, Utah Medical Practice Act, or Chapter 68, Utah Osteopathic Medical Practice Act; and(1)(b) has completed a residency program in anesthesiology. See Utah Code 58-70b-101- Anesthesiologist assistant: means an individual licensed under this chapter. See Utah Code 58-70b-101
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Associate physician: means an individual licensed under Section Utah Code 58-68-102
- Asynchronous technology: means store-and-forward technology that allows a licensed dental professional to transmit a patient's health information to a dentist for viewing at a later time. See Utah Code 58-69-102
- Board: means the Osteopathic Physician and Surgeon's Licensing Board created in Section 58-68-201. See Utah Code 58-68-102
- Board: means the Dentist and Dental Hygienist Licensing Board created in Section 58-69-201. See Utah Code 58-69-102
- Board: means the Physician Assistant Licensing Board created in Section 58-70a-201. See Utah Code 58-70a-102
- Board: means the Physicians Licensing Board created in Section 58-67-201. See Utah Code 58-70b-101
- Collaborating physician: means an individual licensed under Section 58-68-302 who enters into a collaborative practice arrangement with an associate physician. See Utah Code 58-68-102
- Collaborative practice arrangement: means the arrangement described in Section 58-68-807. See Utah Code 58-68-102
- Competence: means possessing the requisite cognitive, non-cognitive, and communicative abilities and qualities to perform effectively within the scope of practice of the physician assistant's practice while adhering to professional and ethical standards. See Utah Code 58-70a-102
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Controlled substance: means the same as that term is defined in Section
58-37-2 . See Utah Code 58-71-102- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Decedent: A deceased person.
- Decedent: means :
(4)(a) a deceased individual whose body or part is or may be the source of an anatomical gift; and(4)(b) includes:(4)(b)(i) a stillborn infant; and(4)(b)(ii) subject to restrictions imposed by law other than this part, a fetus. See Utah Code 26B-8-301- Dental assistant: means an unlicensed individual who engages in, directly or indirectly, supervised acts and duties as defined by division rule made in collaboration with the board. See Utah Code 58-69-102
- Department: means the Department of Commerce. See Utah Code 58-1-102
- Director: means the director of the Division of Professional Licensing. See Utah Code 58-1-102
- Disinterested witness: means :
(5)(a)(i) a witness other than the spouse, child, parent, sibling, grandchild, grandparent, or guardian of the individual who makes, amends, revokes, or refuses to make an anatomical gift; or(5)(a)(ii) another adult who exhibited special care and concern for the individual. See Utah Code 26B-8-301- Division: means the Division of Professional Licensing created in Section
58-1-103 . See Utah Code 58-1-102- Document of gift: means a donor card or other record used to make an anatomical gift. See Utah Code 26B-8-301
- Donor: The person who makes a gift.
- Donor: means an individual whose body or part is the subject of an anatomical gift. See Utah Code 26B-8-301
- Donor registry: means a database that contains records of anatomical gifts and amendments to or revocations of anatomical gifts. See Utah Code 26B-8-301
- Driver license: means a license or permit issued by the Driver License Division of the Department of Public Safety, to operate a vehicle, whether or not conditions are attached to the license or permit. See Utah Code 26B-8-301
- Equal: means , with respect to biological sex, of the same value. See Utah Code 68-3-12.5
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Executive director: means the executive director of the Department of Commerce. See Utah Code 58-1-102
- Eye bank: means a person that is licensed, accredited, or regulated under federal or state law to engage in the recovery, screening, testing, processing, storage, or distribution of human eyes or portions of human eyes. See Utah Code 26B-8-301
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- General supervision: means that the supervising dentist is available for consultation regarding work the supervising dentist has authorized, without regard as to whether the supervising dentist is located on the same premises as the person being supervised. See Utah Code 58-69-102
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guardian: includes a person who:
(14)(a) qualifies as a guardian of a minor or incapacitated person pursuant to testamentary or court appointment; or(14)(b) is appointed by a court to manage the estate of a minor or incapacitated person. See Utah Code 68-3-12.5- Health care facility: means the same as that term is defined in Section 26B-2-201. See Utah Code 58-70a-102
- Hearsay: Statements by a witness who did not see or hear the incident in question but heard about it from someone else. Hearsay is usually not admissible as evidence in court.
- Hospital: means a facility licensed as a hospital under the law of any state or a facility operated as a hospital by the United States, a state, or a subdivision of a state. See Utah Code 26B-8-301
- Identification card: means an identification card issued by the Driver License Division of the Department of Public Safety. See Utah Code 26B-8-301
- Indirect supervision: means that the supervising dentist is present within the facility in which the person being supervised is providing services and is available to provide immediate face-to-face communication with the person being supervised. See Utah Code 58-69-102
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Jurisprudence: The study of law and the structure of the legal system.
- Know: means to have actual knowledge. See Utah Code 26B-8-301
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Licensee: includes any holder of a license, certificate, registration, permit, student card, or apprentice card authorized under this title. See Utah Code 58-1-102
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Local anesthesia: means an agent, whether a natural medicine or nonscheduled prescription drug, which:
(5)(a) is applied topically or by injection associated with the performance of minor office procedures;(5)(b) has the ability to produce loss of sensation to a targeted area of an individual's body;(5)(c) does not cause loss of consciousness or produce general sedation; and(5)(d) is part of the competent practice of naturopathic medicine during minor office procedures. See Utah Code 58-71-102- Mental health therapist: means the same as that term is defined in Section 58-60-102. See Utah Code 58-70a-102
- Minor: means an individual who is under 18 years of age. See Utah Code 26B-8-301
- Minor office procedures: means :
(7)(a)(i) the use of operative, electrical, or other methods for repair and care of superficial lacerations, abrasions, and benign lesions;(7)(a)(ii) removal of foreign bodies located in the superficial tissues, excluding the eye or ear;(7)(a)(iii) the use of antiseptics and local anesthetics in connection with minor office surgical procedures; and(7)(a)(iv) percutaneous injection into skin, tendons, ligaments, muscles, and joints with:(7)(a)(iv)(A) local anesthesia or a prescription drug described in Subsection (8)(d); or(7)(a)(iv)(B) natural substances. See Utah Code 58-71-102- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- Natural medicine: means any:
(8)(a) food, food extract, dietary supplement as defined by the Federal Food, Drug, and Cosmetic Act, Utah Code 58-71-102- Naturopathic childbirth: includes the use of:
(9)(b)(i) natural medicines; and(9)(b)(ii) uncomplicated episiotomy. See Utah Code 58-71-102- Naturopathic mobilization therapy: means manually administering mechanical treatment of body structures or tissues for the purpose of restoring normal physiological function to the body by normalizing and balancing the musculoskeletal system of the body. See Utah Code 58-71-102
- Naturopathic physical medicine: means the use of the physical agents of air, water, heat, cold, sound, light, and electromagnetic nonionizing radiation, and the physical modalities of electrotherapy, acupuncture, diathermy, ultraviolet light, ultrasound, hydrotherapy, naturopathic mobilization therapy, and exercise. See Utah Code 58-71-102
- Naturopathic physician: means an individual licensed under this chapter to engage in the practice of naturopathic medicine. See Utah Code 58-71-102
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Organ procurement organization: means a person designated by the Secretary of the United States Department of Health and Human Services as an organ procurement organization. See Utah Code 26B-8-301
- Oversight: Committee review of the activities of a Federal agency or program.
- Parent: means a parent whose parental rights have not been terminated. See Utah Code 26B-8-301
- Part: means an organ, an eye, or tissue of a human being. See Utah Code 26B-8-301
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Utah Code 26B-8-301
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Physician: means both physicians and surgeons licensed under Section 58-67-301, Utah Medical Practice Act, and osteopathic physicians and surgeons licensed under Section 58-68-301, Utah Osteopathic Medical Practice Act. See Utah Code 58-68-102
- Physician: means the same as that term is defined in Section 58-67-102. See Utah Code 58-70a-102
- Physician: means an individual authorized to practice medicine or osteopathy under the law of any state. See Utah Code 26B-8-301
- Physician assistant: means an individual who is licensed to practice under this chapter. See Utah Code 58-70a-102
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Practice of assisting an anesthesiologist: means personally performing the health care services delegated to the anesthesiologist assistant by the supervising anesthesiologist in accordance with the acceptable medical practice and the American Society of Anesthesiologists' guidance for best practice of anesthesia in a care team model. See Utah Code 58-70b-101
- Practice of dental hygiene: means , regarding humans:
(7)(a) under the general supervision of a dentist, or under a written agreement with a dentist licensed under this chapter, as provided in Section 58-69-801, to:(7)(a)(i) perform preliminary clinical examination of human teeth and gums;(7)(a)(ii) make preliminary instrumental examination of patients' teeth;(7)(a)(iii) expose dental radiographs;(7)(a)(iv) assess dental hygiene status and collaborate with the supervising dentist regarding a dental hygiene treatment plan for a patient;(7)(a)(v) remove deposits, accumulations, calculus, and concretions from the surfaces of human teeth;(7)(a)(vi) remove toxins and debris from subgingival surfaces;(7)(a)(vii) provide dental hygiene care in accordance with a dentist's treatment plan for a patient;(7)(a)(viii) take impressions of teeth or jaws except for impressions or registrations to supply artificial teeth as substitutes for natural teeth; or(7)(a)(ix) engage in other practices of dental hygiene as defined by division rule;(7)(b) under the indirect supervision of a dentist to administer in accordance with standards and ethics of the professions of dentistry and dental hygiene:(7)(b)(i) local anesthesia; or(7)(b)(ii) nitrous oxide analgesia;(7)(c) to represent oneself by any title, degree, or in any other way as being a dental hygienist; or(7)(d) to direct a dental assistant when the supervising dentist is not on the premises. See Utah Code 58-69-102- Practice of dentistry: means the following, regarding humans:
(8)(a) to offer, undertake, or represent that a person will undertake by any means or method, including teledentistry, to:(8)(a)(i) examine, evaluate, diagnose, treat, operate, or prescribe therapy for any disease, pain, injury, deficiency, deformity, or any other condition of the human teeth, alveolar process, gums, jaws, or adjacent hard and soft tissues and structures in the maxillofacial region;(8)(a)(ii) take an appropriate history and physical consistent with the level of professional service to be provided and the available resources in the facility in which the service is to be provided;(8)(a)(iii) take impressions or registrations;(8)(a)(iv) supply artificial teeth as substitutes for natural teeth;(8)(a)(v) remove deposits, accumulations, calculus, and concretions from the surfaces of teeth; and(8)(a)(vi) correct or attempt to correct malposition of teeth;(8)(b) to administer anesthetics necessary or proper in the practice of dentistry only as allowed by an anesthesia permit obtained from the division;(8)(c) to administer and prescribe drugs related to and appropriate in the practice of dentistry;(8)(d) to supervise the practice of a dental hygienist or dental assistant as established by division rule made in collaboration with the board; or(8)(e) to represent oneself by any title, degree, or in any other way that one is a dentist. See Utah Code 58-69-102- Practice of mental health therapy: means the same as that term is defined in Section 58-60-102. See Utah Code 58-70a-102
- Practice of naturopathic medicine: means :
(13)(a) a system of primary health care for the prevention, diagnosis, and treatment of human health conditions, injuries, and diseases that uses education, natural medicines, and natural therapies, to support and stimulate the patient's intrinsic self-healing processes by:(13)(a)(i) using naturopathic childbirth, but only if:(13)(a)(i)(A) the licensee meets standards of the American College of Naturopathic Obstetricians (ACNO) or ACNO's successor as determined by the division in collaboration with the board; and(13)(a)(i)(B) the licensee follows a written plan for naturopathic physicians practicing naturopathic childbirth approved by the division in collaboration with the board, which includes entering into an agreement with a consulting physician and surgeon or osteopathic physician, in cases where the scope of practice of naturopathic childbirth may be exceeded and specialty care and delivery is indicated, detailing the guidelines by which the naturopathic physician will:(13)(a)(i)(B)(I) refer patients to the consulting physician; and(13)(a)(i)(B)(II) consult with the consulting physician;(13)(a)(ii) using naturopathic mobilization therapy;(13)(a)(iii) using naturopathic physical medicine;(13)(a)(iv) using minor office procedures;(13)(a)(v) prescribing or administering natural medicine;(13)(a)(vi) prescribing medical equipment and devices, diagnosing by the use of medical equipment and devices, and administering therapy or treatment by the use of medical devices necessary and consistent with the competent practice of naturopathic medicine;(13)(a)(vii) prescribing barrier devices for contraception;(13)(a)(viii) using dietary therapy;(13)(a)(ix) taking and using diagnostic x-rays, electrocardiograms, ultrasound, and physiological function tests;(13)(a)(x) taking of body fluids for clinical laboratory tests and using the results of the tests in diagnosis;(13)(a)(xi) taking of a history from and conducting of a physical examination upon a human patient; and(13)(a)(xii) administering local anesthesia during the performance of a minor office procedure;(13)(b) to maintain an office or place of business for the purpose of doing any of the acts described in Subsection (13)(a), whether or not for compensation; or(13)(c) to use, in the conduct of any occupation or profession pertaining to the diagnosis or treatment of human diseases or conditions, in any printed material, stationery, letterhead, envelopes, signs, or advertisements, the designation "naturopathic physician" "naturopathic doctor" "naturopath" "doctor of naturopathic medicine" "doctor of naturopathy" "naturopathic medical doctor" "naturopathic medicine" "naturopathic health care" "naturopathy" "N. See Utah Code 58-71-102- Practice of osteopathic medicine: means :
(19)(a)(i) to diagnose, treat, correct, administer anesthesia, or prescribe for any human disease, ailment, injury, infirmity, deformity, pain, or other condition, physical or mental, real or imaginary, or to attempt to do so, by any means or instrumentality, which in whole or in part is based upon emphasis of the importance of the musculoskeletal system and manipulative therapy in the maintenance and restoration of health, by an individual in Utah or outside of the state upon or for any human within the state;(19)(a)(ii) when a person not licensed as a physician directs a licensee under this chapter to withhold or alter the health care services that the licensee has ordered;(19)(a)(iii) to maintain an office or place of business for the purpose of doing any of the acts described in Subsection (19)(a)(i) or (ii) whether or not for compensation; or(19)(a)(iv) to use, in the conduct of any occupation or profession pertaining to the diagnosis or treatment of human diseases or conditions, in any printed material, stationery, letterhead, envelopes, signs, or advertisements, the designation "doctor" "doctor of osteopathic medicine" "osteopathic physician" "osteopathic surgeon" "osteopathic physician and surgeon" "Dr. See Utah Code 58-68-102- Prescription drug: means a drug that is required by federal or state law or rule to be dispensed only by prescription or is restricted to administration only by practitioners. See Utah Code 58-71-102
- Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
- Probate: Proving a will
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Procurement organization: means an eye bank, organ procurement organization, or tissue bank. See Utah Code 26B-8-301
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Public health setting: means :
(9)(a) an individual's residence, if the individual is unable to leave the residence;(9)(b) a school, as part of a school-based program;(9)(c) a nursing home;(9)(d) an assisted living or long-term care facility;(9)(e) a community health center;(9)(f) a federally-qualified health center; or(9)(g) a mobile dental health program that employs a dentist who is licensed under this chapter. See Utah Code 58-69-102- Reasonably available: means able to be contacted by a procurement organization without undue effort and willing and able to act in a timely manner consistent with existing medical criteria necessary for the making of an anatomical gift. See Utah Code 26B-8-301
- Recipient: means an individual into whose body a decedent's part has been or is intended to be transplanted. See Utah Code 26B-8-301
- Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Utah Code 26B-8-301
- Refusal: means a record created under Section 26B-8-306 that expressly states an intent to bar other persons from making an anatomical gift of an individual's body or part. See Utah Code 26B-8-301
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Service of process: The service of writs or summonses to the appropriate party.
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- Sign: means , with the present intent to authenticate or adopt a record:
(27)(a) to execute or adopt a tangible symbol; or(27)(b) to attach to or logically associate with the record an electronic symbol, sound, or process. See Utah Code 26B-8-301- Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
- State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Utah Code 26B-8-301
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Statute: A law passed by a legislature.
- Subpoena: A command to a witness to appear and give testimony.
- Supervising dentist: means a licensed dentist who has agreed to provide supervision of a dental hygienist or unlicensed individual in accordance with the provisions of this chapter. See Utah Code 58-69-102
- Supervision standards: means standards established by the division through rule that:
(5)(a) prohibit an anesthesiologist from supervising more than four anesthesiologist assistants at any one time; and(5)(b) comply with the rules and regulations for anesthesia service reimbursement created by the Centers for Medicare and Medicaid Services to the extent that the rules and regulations do not conflict with state law. See Utah Code 58-70b-101- Teledentistry: means the practice of dentistry using synchronous or asynchronous technology. See Utah Code 58-69-102
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Tissue: means a portion of the human body other than an organ or an eye. See Utah Code 26B-8-301
- Tissue bank: means a person that is licensed, accredited, or regulated under federal or state law to engage in the recovery, screening, testing, processing, storage, or distribution of tissue. See Utah Code 26B-8-301
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
- Unlawful conduct: means the same as that term is defined in Subsection
58-1-501 (1). See Utah Code 58-1-102- Unlawful conduct: means the same as that term is defined in Sections 58-1-501 and 58-68-501. See Utah Code 58-68-102
- Unlawful conduct: means the same as that term is defined in Sections 58-1-501 and 58-69-501. See Utah Code 58-69-102
- Unlawful conduct: means the same as that term is defined in Sections 58-1-501 and 58-70a-502. See Utah Code 58-70a-102
- Unlawful conduct: means the same as that term is defined in Sections
58-1-501 and58-71-501 . See Utah Code 58-71-102- Unprofessional conduct: means the same as that term is defined in Subsection

- Unprofessional conduct: means "unprofessional conduct":

- Writing: includes :
