Terms Used In Utah Code > Title 31A > Chapter 26 > Part 1 - General Provisions

• adjusting: means directing or conducting the investigation, negotiation, or settlement of a claim under an insurance policy, on behalf of an insurer, policyholder, or a claimant under an insurance policy. See Utah Code 31A-26-102
• Behavioral health transition facility: means a nonsecure correctional facility operated by the department for the purpose of providing a therapeutic environment for offenders receiving mental health services. See Utah Code 64-13-1
• Contract: A legal written agreement that becomes binding when signed.
• Conviction: A judgement of guilt against a criminal defendant.
• Correctional facility: means any facility operated to house offenders in a secure or nonsecure setting:
       (4)(a) by the department; or
       (4)(b) under a contract with the department. See Utah Code 64-13-1
• Criminal risk factors: means an individual's characteristics and behaviors that:
       (5)(a) affect the individual's risk of engaging in criminal behavior; and
       (5)(b) are diminished when addressed by effective treatment, supervision, and other support resources, resulting in a reduced risk of criminal behavior. See Utah Code 64-13-1
• Department: means the Department of Corrections. See Utah Code 64-9b-2
• Department: means the Department of Corrections. See Utah Code 64-13-1
• Designated home state: means the state or territory of the United States or the District of Columbia:
       (2)(a) in which an insurance adjuster does not maintain the adjuster's principal:

            (2)(a)(i) place of residence; or

            (2)(a)(ii) place of business;
       (2)(b) if the resident state, territory, or District of Columbia of the adjuster does not license adjusters for the line of authority sought, the adjuster has qualified for the license as if the person were a resident in the state, territory, or District of Columbia described in Subsection (2)(a), including an applicable:

            (2)(b)(i) examination requirement;

            (2)(b)(ii) fingerprint background check requirement; and

            (2)(b)(iii) continuing education requirement; and
       (2)(c) that the adjuster has designated as the insurance adjuster's designated home state. See Utah Code 31A-26-102
• Executive director: means the executive director of the Department of Corrections. See Utah Code 64-13-1
• Home state: means :
       (3)(a) a state or territory of the United States or the District of Columbia in which an insurance adjuster:

            (3)(a)(i) maintains the adjuster's principal:

                 (3)(a)(i)(A) place of residence; or

                 (3)(a)(i)(B) place of business; and

            (3)(a)(ii) is licensed to act as a resident adjuster; or
       (3)(b) if the resident state, territory, or the District of Columbia described in Subsection (3)(a) does not license adjusters for the line of authority sought, a state, territory, or the District of Columbia:

            (3)(b)(i) in which the adjuster is licensed;

            (3)(b)(ii) in which the adjuster is in good standing; and

            (3)(b)(iii) that the adjuster has designated as the adjuster's designated home state. See Utah Code 31A-26-102
• Inmate: means an individual who is:
       (12)(a) committed to the custody of the department; and
       (12)(b) housed at a correctional facility or at a county jail at the request of the department. See Utah Code 64-13-1
• Insurance: includes :
            (96)(b)(i) a risk distributing arrangement providing for compensation or replacement for damages or loss through the provision of a service or a benefit in kind;
            (96)(b)(ii) a contract of guaranty or suretyship entered into by the guarantor or surety as a business and not as merely incidental to a business transaction; and
            (96)(b)(iii) a plan in which the risk does not rest upon the person who makes an arrangement, but with a class of persons who have agreed to share the risk. See Utah Code 31A-1-301
• Insurance adjuster: means a person who directs or conducts the investigation, negotiation, or settlement of a claim under an insurance policy other than life insurance or an annuity, on behalf of an insurer, policyholder, or a claimant under an insurance policy. See Utah Code 31A-1-301
• License: includes a certificate of authority issued to an insurer. See Utah Code 31A-1-301
• Offender: means an individual who has been convicted of a crime for which the individual may be committed to the custody of the department and is at least one of the following:
       (13)(a) committed to the custody of the department;
       (13)(b) on probation; or
       (13)(c) on parole. See Utah Code 64-13-1
• Person: includes :
       (146)(a) an individual;
       (146)(b) a partnership;
       (146)(c) a corporation;
       (146)(d) an incorporated or unincorporated association;
       (146)(e) a joint stock company;
       (146)(f) a trust;
       (146)(g) a limited liability company;
       (146)(h) a reciprocal;
       (146)(i) a syndicate; or
       (146)(j) another similar entity or combination of entities acting in concert. See Utah Code 31A-1-301
• Policy: includes a service contract issued by:
            (150)(b)(i) a motor club under Chapter 11, Motor Clubs;
            (150)(b)(ii) a service contract provided under Chapter 6a, Service Contracts; and
            (150)(b)(iii) a corporation licensed under:

                 (150)(b)(iii)(A) Chapter 7, Nonprofit Health Service Insurance Corporations; or

                 (150)(b)(iii)(B) Chapter 8, Health Maintenance Organizations and Limited Health Plans. See Utah Code 31A-1-301
• Policyholder: means a person who controls a policy, binder, or oral contract by ownership, premium payment, or otherwise. See Utah Code 31A-1-301
• Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
• Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
• State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
• United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
• Writing: includes :
       (48)(a) printing;
       (48)(b) handwriting; and
       (48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5
