- Adverse action: means to discharge, threaten, or otherwise discriminate against an employee in any manner that affects the employee's employment, including compensation, terms, conditions, location, rights, immunities, promotions, or privileges. See Utah Code 34-48-102
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Agency plan: means a water infrastructure plan adopted by a relevant agency. See Utah Code 73-10g-601
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Board: means the Board of Water Resources. See Utah Code 73-10g-102
- Capital asset: means an asset that:(1)(a) is a significant investment or an essential component necessary to provide water service, including:(1)(a)(i) a facility;(1)(a)(ii) infrastructure, whether above or below ground level;(1)(a)(iii) equipment; or(1)(a)(iv) a communications network; and(1)(b) is owned by a water provider. See Utah Code 73-10g-501
- Council: means the Water District Water Development Council created pursuant to Section
11-13-228 . See Utah Code 73-10g-701 - Division: means the Division of Water Resources. See Utah Code 73-10g-102
- Division: means the Division of Water Resources. See Utah Code 73-10g-701
- Employer: means a person, including the state or a political subdivision of the state, that has one or more workers or operators employed in the same business, or in or about the same establishment, under any contract of hire, express or implied, oral or written. See Utah Code 34-48-102
- Executive director: means the executive director of the Department of Natural Resources. See Utah Code 73-10g-601
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Governing body: means :(2)(a) for a political subdivision, the political subdivision governing body defined in Section 63A-15-102; or(2)(b) for a private entity, the private entity's board of directors, managing members, partners, or equivalent body. See Utah Code 73-10g-501
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Law enforcement agency: is a s defined in Section 53-1-102. See Utah Code 34-48-102
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Relevant agency: means :(3)(a) the Division of Water Resources;(3)(b) the Division of Drinking Water;(3)(c) the Division of Water Quality;(3)(d) the Housing and Community Development Division; and(3)(e) the Department of Agriculture and Food. See Utah Code 73-10g-601
- Retail water supplier: means the same as that term is defined in Section 19-4-102. See Utah Code 73-10g-501
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- State council: means the Water Development Coordinating Council created in Sections
73-10c-3 and79-2-201 . See Utah Code 73-10g-601 - State or local entity: means :(3)(a) a department, division, commission, agency, or other instrumentality of state government; or(3)(b) a political subdivision or the political subdivision's instrumentalities. See Utah Code 73-10g-701
- Statute: A law passed by a legislature.
- Utah Watersheds Council: means the Utah Watersheds Council created in Section
73-10g-304 . See Utah Code 73-10g-601 - Water agent: means the Utah water agent appointed by the governor under Section
73-10g-702 . See Utah Code 73-10g-701 - Water conservancy district: means the same as that term is defined in Section 73-10-32. See Utah Code 73-10g-501
- Water Infrastructure Fund: means the enterprise fund created in Section
73-10g-107 . See Utah Code 73-10g-102 - Water infrastructure fund money: means money in the Water Infrastructure Fund created by Section
73-10g-107 . See Utah Code 73-10g-601 - Water infrastructure project: means :(5)(a) the following for the supply, control, measurement, treatment, distribution, storage, or transport of water:(5)(a)(i) planning;(5)(a)(ii) design;(5)(a)(iii) construction;(5)(a)(iv) reconstruction;(5)(a)(v) improvement;(5)(a)(vi) renovation;(5)(a)(vii) acquisition; or(5)(a)(viii) seismic upgrade; or(5)(b) a project to engage in planning consistent with Part 6, Planning and Prioritization. See Utah Code 73-10g-102
- Water provider: means :(5)(a) a retail water supplier; or(5)(b) a water conservancy district. See Utah Code 73-10g-501
