Terms Used In Utah Code > Title 53G > Chapter 3 - School District Creation and Change
- Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Allocation date: means :(1)(a) July 1 of the second calendar year following the local school board election date as described in Section
53G-3-302 ; or(1)(b) another date to which the new local school board and reorganized school board agree. See Utah Code 53G-3-102- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Big game: means species of hoofed protected wildlife. See Utah Code 23A-1-101
- City: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- County legislative body: means :
(8)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(8)(b) the county council, in the county executive-council optional form of government authorized by Section17-52a-203 ; and(8)(c) the county council, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- Creation date: means the date on which voters approve the creation of a new school district under Section

23A-2-202 . See Utah Code 23A-1-101- Divided school district: means :
(3)(a) an existing school district from which a new school district is created under SectionUtah Code 53G-3-102 - Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
- Donor: The person who makes a gift.
- Equal: means , with respect to biological sex, of the same value. See Utah Code 68-3-12.5
- Feasibility study: means a study:
(4)(a)(i) conducted by:(4)(a)(i)(A) a school district, municipal legislative body, or interlocal agreement participants before July 1, 2024; or(4)(a)(i)(B) the Office of the Legislative Auditor General, subject to prioritization by the Legislative Audit Subcommittee; and(4)(a)(ii) to determine:(4)(a)(ii)(A) the financial viability for a new school district and reorganized new school district that is contained within the boundaries of a divided school district;(4)(a)(ii)(B) the financial impact on a new school district and reorganized new school district that is contained within the boundaries of a divided school district; and(4)(a)(ii)(C) the impact of the tax burden on taxpayers within the boundaries of the proposed new school district. See Utah Code 53G-3-102- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fishing: means to take fish or crayfish by any means. See Utah Code 23A-1-101
- Hunting: means to take or pursue a reptile, amphibian, bird, or mammal by any means. See Utah Code 23A-1-101
- Interlocal agreement participant: means a public agency, as that term is defined in Section
11-13-103 , that enters into an agreement with one or more other public agencies for the purpose described in and in accordance with Title 11, Chapter 13, Interlocal Cooperation Act. See Utah Code 53G-3-102- Isolated area: means an area that:
(6)(a) is entirely within the boundaries of an existing school district;(6)(b) is contiguous to the proposed new school district;(6)(c) has a combined student population of fewer than 5,000 students; and(6)(d) because of the creation of a new school district from the existing district in which the area is located, would become completely geographically isolated. (18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. - Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Municipality: means the same as that term is defined in Section
10-1-104 . See Utah Code 53G-3-102- New school district: means a school district created under Section
Utah Code 53G-3-102 - Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Permit: means a paper-based or electronic document that grants authority to engage in specified activities under this title or a rule or proclamation of the Wildlife Board. See Utah Code 23A-1-101
- Person: means an individual, association, partnership, government agency, corporation, or an agent of the individual, association, partnership, government agency, or corporation. See Utah Code 23A-1-101
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Protected wildlife: means wildlife, except as provided in Subsection (43)(b). See Utah Code 23A-1-101
- real property: includes :
(31)(a) land;(31)(b) a tenement;(31)(c) a hereditament;(31)(d) a water right;(31)(e) a possessory right; and(31)(f) a claim. See Utah Code 68-3-12.5- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Regional advisory council: means a council created under Section
23A-2-303 . See Utah Code 23A-1-101- Reorganized new school district: means the remaining portion of the divided school district after the creation of a new school district under Subsection
Utah Code 53G-3-102 - Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
- Spotlighting: means throwing or casting the rays of a spotlight, headlight, or other artificial light on a highway or in a field, woodland, or forest while having in possession a weapon by which protected wildlife may be killed. See Utah Code 23A-1-101
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Town: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
- Wildlife: means :
(61)(a) crustaceans, including brine shrimp and crayfish;(61)(b) mollusks; and(61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101- Wildlife Board: means the board created in Section
23A-2-301 . See Utah Code 23A-1-101- Wildlife parts: means biological material derived from the body or anatomy of wildlife, including:
