- Actual excess cost: means the difference in cost between:(1)(a) the standard cost of a facility; and(1)(b) the actual cost of the facility, including any necessary right-of-way, as determined in accordance with Section 54-14-203. See Utah Code 54-14-103
- Adjudicative proceeding: means :(2)(a) an action by a board, commission, department, officer, or other administrative unit of the state that determines the legal rights, duties, privileges, immunities, or other legal interests of one or more identifiable persons, including an action to grant, deny, revoke, suspend, modify, annul, withdraw, or amend an authority, right, or license; and(2)(b) judicial review of an action described in Subsection (2)(a). See Utah Code 68-3-12.5
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Board: means the Utility Facility Review Board. See Utah Code 54-14-103
- City: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5 - Commission: means the Public Service Commission. See Utah Code 54-2-1
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the Department of Transportation created in Section 72-1-201. See Utah Code 54-2-1
- Department: means the Department of Health and Human Services created in Section
26B-1-201 . See Utah Code 26A-1-102 - Estimated excess cost: means any material difference in estimated cost between the costs of a facility, including any necessary right-of-way, if constructed in accordance with the requirements of a local government and the standard cost of the facility. See Utah Code 54-14-103
- Facility: includes a high voltage power line route as defined in Section 54-18-102. See Utah Code 54-14-103
- Gas pipeline: means equipment, material, and structures used to transport gas to the public utility's customers, including:(6)(a)(i) pipe;(6)(a)(ii) a compressor;(6)(a)(iii) a pressure regulator;(6)(a)(iv) a support structure; and(6)(a)(v) any other equipment or structure used to transport or facilitate transportation of gas through a pipe. - Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Land: includes :(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5
- Local health department: means :(6)(a) a single county local health department;(6)(b) a multicounty local health department;(6)(c) a united local health department; or(6)(d) a multicounty united local health department. See Utah Code 26A-1-102
- Multicounty local health department: means a local health department that is formed under Section
26A-1-105 and that serves two or more contiguous counties and municipalities within those counties. See Utah Code 26A-1-102 - Multicounty united local health department: means a united local health department that is formed under Section
Utah Code 26A-1-102 - Oversight: Committee review of the activities of a Federal agency or program.
- Pay: includes , in reference to a local government paying the actual excess cost of a facility, payment by:(8)(a) a special district under Title 17B, Limited Purpose Local Government Entities - Special Districts;(8)(b) a special service district under Title 17D, Chapter 1, Special Service District Act; or(8)(c) a private entity other than the public utility pursuant to a regulation or decision of the local government. See Utah Code 54-14-103
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Public utility: includes every railroad corporation, gas corporation, electrical corporation, distribution electrical cooperative, wholesale electrical cooperative, telephone corporation, telegraph corporation, water corporation, sewerage corporation, heat corporation, and independent energy producer not described in Section 54-2-201 where the service is performed for, or the commodity delivered to, the public generally, or in the case of a gas corporation or electrical corporation where the gas or electricity is sold or furnished to any member or consumers within the state for domestic, commercial, or industrial use. - Quorum: The number of legislators that must be present to do business.
- Standard cost: means the estimated cost of a facility, including any necessary right-of-way, if constructed in accordance with:(9)(a)(i) the public utility's normal practices; and(9)(a)(ii) zoning, subdivision, and building code regulations of a local government, including siting, setback, screening, and landscaping requirements:(9)(a)(ii)(A) imposed on similar land uses in the same zone; and(9)(a)(ii)(B) that do not impair the ability of the public utility to provide service to its customers in a safe, reliable, adequate, and efficient manner. - State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Substation: means a separate space within which electric supply equipment is located for the purpose of switching, regulating, transforming, or otherwise modifying the characteristics of electricity, including:(10)(a)(i) electrical equipment such as transformers, circuit breakers, voltage regulating equipment, buses, switches, capacitor banks, reactors, protection and control equipment, and other related equipment;(10)(a)(ii) the site at which the equipment is located, any foundations, support structures, buildings, or driveways necessary to locate, operate, and maintain the equipment at the site; and(10)(a)(iii) the structure intended to restrict access to the equipment to qualified persons. - Town: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5 - Transmission line: includes , for purposes of Title 54, Chapter 18, Siting of High Voltage Power Line Act, an electrical line as described in Subsection (11)(a) operated at a nominal voltage of 230 kilovolts or more. See Utah Code 54-14-103
