- Agency contract: means an agreement in which a student athlete authorizes a person to negotiate or solicit on behalf of the athlete a professional-sports-services contract or an endorsement contract. See Utah Code 58-87-102
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Athlete agent: means an individual, whether or not registered under this chapter, who:(2)(a)(i) directly or indirectly recruits or solicits a student athlete to enter into an agency contract or, for compensation, procures employment or offers, promises, attempts, or negotiates to obtain employment for a student athlete as a professional athlete or member of a professional sports team or organization;(2)(a)(ii) for compensation or in anticipation of compensation related to a student athlete's participation in athletics:(2)(a)(ii)(A) serves the athlete in an advisory capacity on a matter related to finances, business pursuits, or career management decisions, unless the individual is an employee of an educational institution acting exclusively as an employee of the institution for the benefit of the institution; or(2)(a)(ii)(B) manages the business affairs of the athlete by providing assistance with bills, payments, contracts, or taxes; or(2)(a)(iii) in anticipation of representing a student athlete for a purpose related to the athlete's participation in athletics:(2)(a)(iii)(A) gives consideration to the student athlete or another person;(2)(a)(iii)(B) serves the athlete in an advisory capacity on a matter related to finances, business pursuits, or career management decisions; or(2)(a)(iii)(C) manages the business affairs of the athlete by providing assistance with bills, payments, contracts, or taxes. - Athletic director: means the individual responsible for administering the overall athletic program of an educational institution or, if an educational institution has separately administered athletic programs for male students and female students, the athletic program for males or the athletic program for females, as appropriate. See Utah Code 58-87-102
- Child: means :
(6)(a) a son or daughter under the age of 18 years who is not otherwise emancipated, self-supporting, married, or a member of the armed forces of the United States;(6)(b) a son or daughter over the age of 18 years, while enrolled in high school during the normal and expected year of graduation and not otherwise emancipated, self-supporting, married, or a member of the armed forces of the United States; or(6)(c) a son or daughter of any age who is incapacitated from earning a living and is without sufficient means. See Utah Code 26B-9-201- Child support: means the same as that term is defined in Section 26B-9-301. See Utah Code 26B-9-201
- Child support guidelines: means guidelines as defined in Section 78B-12-102. See Utah Code 26B-9-201
- Child support order: means the same as that term is defined in Section 26B-9-301. See Utah Code 26B-9-201
- Contract: A legal written agreement that becomes binding when signed.
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Director: means the director of the Division of Professional Licensing. See Utah Code 58-1-102
- Division: means the Division of Professional Licensing created in Section
58-1-103 . See Utah Code 58-1-102- Educational institution: includes a public or private elementary school, secondary school, technical or vocational school, community college, college, and university. See Utah Code 58-87-102
- Endorsement contract: means an agreement under which a student athlete is employed or receives consideration to use on behalf of the other party any value that the student athlete may have because of publicity, reputation, following, or fame obtained because of athletic ability or performance. See Utah Code 58-87-102
- Enrolled: means registered for courses and attending athletic practice or class. See Utah Code 58-87-102
- Female: means the characteristic of an individual whose biological reproductive system is of the general type that functions in a way that could produce ova. See Utah Code 68-3-12.5
- Fiduciary: A trustee, executor, or administrator.
- Guardian: includes a person who:
(14)(a) qualifies as a guardian of a minor or incapacitated person pursuant to testamentary or court appointment; or(14)(b) is appointed by a court to manage the estate of a minor or incapacitated person. See Utah Code 68-3-12.5- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guidelines: means the same as that term is defined in Section 78B-12-102. See Utah Code 26B-9-201
- Income: means the same as that term is defined in Section 26B-9-101. See Utah Code 26B-9-201
- Intercollegiate sport: means a sport played at the collegiate level for which eligibility requirements for participation by a student athlete are established by a national association that promotes or regulates collegiate athletics. See Utah Code 58-87-102
- IV-D services: means services provided pursuant to Part D of Title IV of the Social Security Act, Utah Code 26B-9-201 v2
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Male: means the characteristic of an individual whose biological reproductive system is of the general type that functions to fertilize the ova of a female. See Utah Code 68-3-12.5
- Office: means the Office of Recovery Services. See Utah Code 26B-9-201
- Parent: means a natural parent or an adoptive parent of a dependent child. See Utah Code 26B-9-201
- Person: means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency, or instrumentality, or other legal entity. See Utah Code 58-87-102
- Plaintiff: The person who files the complaint in a civil lawsuit.
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Utah Code 58-87-102
- Recruit or solicit: means attempting to influence the choice of an athlete agent by a student athlete or, if the athlete is a minor, a parent or guardian of the athlete. See Utah Code 58-87-102
- Registration: means registration as an athlete agent under this chapter. See Utah Code 58-87-102
- Service of process: The service of writs or summonses to the appropriate party.
- Sign: means , with present intent to authenticate or adopt a record:
(15)(a) to execute or adopt a tangible symbol; or(15)(b) to attach to or logically associate with the record an electronic symbol, sound, or process. See Utah Code 58-87-102- State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Utah Code 58-87-102
- Student athlete: means an individual who is eligible to attend an educational institution and engages in, is eligible to engage in, or may be eligible in the future to engage in, any interscholastic or intercollegiate sport. See Utah Code 58-87-102
- Support: includes past-due, present, and future obligations established by:
(27)(a) a tribunal or imposed by law for the financial support, maintenance, medical, or dental care of a dependent child; and(27)(b) a tribunal for the financial support of a spouse or former spouse with whom the obligor's dependent child resides if the obligor also owes a child support obligation that is being enforced by the state. See Utah Code 26B-9-201- Support order: means the same as child support order. See Utah Code 26B-9-201
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
