Terms Used In Vermont Statutes Title 14 Sec. 3074
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Person: shall include any natural person, corporation, municipality, the State of Vermont or any department, agency, or subdivision of the State, and any partnership, unincorporated association, or other legal entity. See
- State: when applied to the different parts of the United States may apply to the District of Columbia and any territory and the Commonwealth of Puerto Rico. See
§ 3074. Commitment, sterilization, involuntary treatment, and involuntary medication
Nothing in this chapter shall give the guardian of a person authority to:
(1) place that person in a State school or hospital except pursuant to 18 V.S.A. § 7601 et seq. or 18 V.S.A. § 8801 et seq.
(2) consent to an involuntary treatment or medication petition pursuant to 18 Vt. Stat. Ann. chapter 181.
(3) consent to sterilization or to a petition for involuntary sterilization pursuant to 18 Vt. Stat. Ann. chapter 204.
(4) consent to a petition for custody, care, or habilitation filed pursuant to 18 Vt. Stat. Ann. chapter 206. (Added 1979, No. 76, § 15; amended 2007, No. 186 (Adj. Sess.), § 1.)
