Terms Used In Vermont Statutes Title 20 Sec. 2303

  • Agency: means any State or local law enforcement agency, any State agency except the Vermont Department of Fish and Wildlife, and any local government entity. See
  • Commissioner: means the Commissioner of Public Safety. See
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • State: when applied to the different parts of the United States may apply to the District of Columbia and any territory and the Commonwealth of Puerto Rico. See

§ 2303. Delivery to Commissioner of Public Safety

(a) Any unlawful firearm in the possession of an agency that is not needed as evidence for or in a criminal prosecution or other judicial or administrative proceeding shall, within 30 days of its receipt by the agency, be delivered to such place and in such manner as the Commissioner of Public Safety designates for ultimate disposition in accordance with the provisions of this chapter.

(b) Any unlawful firearm in the possession of an agency needed as evidence for or in a criminal prosecution or other judicial or administrative proceeding may be retained by the agency for such purposes and until the conclusion of such prosecution or proceeding. Upon notice to the agency from a State‘s Attorney, other prosecuting official, or other State or federal official having jurisdiction over the subject matter that the unlawful firearm may be released, the agency shall, within 30 days of such notification, deliver the unlawful firearm to such place and in such manner as the Commissioner of Public Safety designates for ultimate disposition in accordance with the provisions of this chapter.
