Terms Used In Vermont Statutes Title 23 Sec. 1211

  • Alcohol: includes alcohol, malt beverages, spirits, fortified wines, and vinous beverages, as defined in 7 V. See
  • Alcohol concentration: means

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Motor vehicle: includes all vehicles propelled or drawn by power other than muscular power, except farm tractors, vehicles running only upon stationary rails or tracks, motorized highway building equipment, road making appliances, snowmobiles, tracked vehicles, motor-assisted bicycles, electric bicycles, or electric personal assistive mobility devices.   • Person: includes any natural person, corporation, association, co-partnership, company, firm, or other aggregation of individuals. See

§ 1211. Construction of cross references

For the purposes of computing offenses under this chapter, references to section 1201 of this title shall be construed to include sections of present or prior law of this or any other jurisdiction that prohibited operating, attempting to operate, or being in actual physical control of a motor vehicle on a highway while under the influence of alcohol or drugs, or both, or while having 0.08 percent or more by weight of alcohol in the person‘s blood or an alcohol concentration of 0.08 or more.
