- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
§ 692. Powers of clerk in absence of judge
In the absence of the judge:
(1) the clerk may continue a cause;
(2) the clerk may set conditions of release in noncapital criminal cases prior to trial as provided by law or by rule promulgated by the Supreme Court. (Amended 1973, No. 118, § 1, eff. Oct. 1, 1973.)
