Terms Used In Vermont Statutes Title 5 Sec. 1002
- Airport: means any area of land or water set aside by the Agency, any political subdivision, or person, except a restricted landing area, that is designed for the landing and take-off of aircraft, and used or to be used in the interest of the general public whether or not facilities are provided for the shelter, servicing, or repair of aircraft, or for receiving or discharging passengers or cargo, and all appurtenant areas used or suitable for airport buildings or other airport facilities, including all appurtenant rights-of-way. - Airport hazard: means a structure, object of natural growth, or use of land that obstructs the air space required for the flight of aircraft in landing or taking off at an airport or restricted landing area or is otherwise hazardous to landing or taking off. See
- Board: means the Transportation Board. See
- Political subdivision: means any county, city, town, or other municipality. See
§ 1002. Airport zoning commission
Prior to the initial zoning of any airport hazard area under this chapter, the political subdivision or joint airport zoning board that is to adopt the regulations shall appoint a commission, to be known as the airport zoning commission, to recommend the boundaries of the various zones to be established and the regulations to be adopted. The commission shall make a preliminary report and hold public hearings before submitting its final report. The legislative body of the political subdivision or the joint airport zoning board shall not hold its public hearings or take other action until it has received the final report of the Commission. When a municipal planning commission or regional planning commission already exists, it may be appointed as the airport zoning commission. (Added 1985, No. 222 (Adj. Sess.), § 2.)
