Terms Used In Vermont Statutes Title 5 Sec. 40

  • Board: means the Transportation Board. See
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • State: when applied to the different parts of the United States may apply to the District of Columbia and any territory and the Commonwealth of Puerto Rico. See

§ 40. Pleadings; rules of practice; findings of fact

(a) The forms, pleadings, and rules of practice and procedure before the Board shall be prescribed by the Board.

(b) The Board shall hear all matters within its jurisdiction and make findings of fact. It shall state its rulings of law when required. Upon judicial review pursuant to 19 V.S.A. § 5(c), the Board’s findings of fact shall be accepted unless clearly erroneous. (Added 1985, No. 222 (Adj. Sess.), § 1; amended 1993, No. 172 (Adj.
