Virginia Code 15.2-1226: Authority of certain counties over Smith Mountain Lake.
A. The governing bodies of Bedford, Franklin, and Pittsylvania Counties may by ordinance regulate the land of their respective counties in and around Smith Mountain Lake below the 800-foot contour concerning the location, size, and length of wharves, piers, boathouses, docks, bulkheads, and similar structures to provide for safe navigation of the lake. Such ordinance shall not conflict with the provisions of the Uniform Statewide Building Code or with the rights and responsibilities accorded Appalachian Power Company under its federal license to operate the Smith Mountain Project. - Governing body: means the board of supervisors of a county, council of a city, or council of a town, as the context may require. See Virginia Code 15.2-102
1. Procedures for approval of construction of such by the governing body or its designated agent; and
2. Penalties for violation of the ordinance.
B. Such governing bodies may act jointly in the enactment, administration, and enforcement of such an ordinance pursuant to § 15.2-1300.
