Notwithstanding the provisions of § 62.1-266, the Board shall waive the expiration of any ground water withdrawal permit for a well that serves exclusively residential users, is located in the Eastern Virginia Groundwater Management Area north of the Occoquan River, and is located within five miles of any commercial or industrial permitted ground water withdrawal until all such permitted withdrawals for commercial or industrial permitted wells within five miles of the subject residential well have been halted for five years. No sooner than five years after the termination of such commercial or industrial withdrawals, the Department shall assess whether the termination of the commercial or industrial withdrawals has substantially mitigated the stress upon the aquifer in proximity to the permitted residential well and redetermine whether the ground water withdrawal permit for the residential well shall be renewed.

  • Ground water: means any water, except capillary moisture, beneath the land surface in the zone of saturation or beneath the bed of any stream, lake, reservoir or other body of surface water wholly or partially within the boundaries of the Commonwealth, whatever the subsurface geologic structure in which such water stands, flows, percolates or otherwise occurs.   • Ground water withdrawal permit: means a certificate issued by the Board permitting the withdrawal of a specified quantity of ground water in a ground water management area. See Virginia Code 62.1-255
