The obligations imposed by this title on an issuer apply to a document even if:
Terms Used In Virginia Code 8.7-401
- Bailee: means the person who by a warehouse receipt, bill of lading or other document acknowledges possession of goods and contracts to deliver them. See Virginia Code 8.7-102
- Document: means document of title as defined in the general definitions in Virginia Code 8.7-102
- Goods: means all things that are treated as movable for the purposes of a contract of storage or transportation. See Virginia Code 8.7-102
- Issuer: means a bailee who issues a document except that in relation to an unaccepted delivery order it means the person who orders the possessor of goods to deliver. See Virginia Code 8.7-102
- Person: includes any individual, corporation, partnership, association, cooperative, limited liability company, trust, joint venture, government, political subdivision, or any other legal or commercial entity and any successor, representative, agent, agency, or instrumentality thereof. See Virginia Code 1-230
- Warehouseman: is a person engaged in the business of storing goods for hire. See Virginia Code 8.7-102
(a) the document may not comply with the requirements of this title or of any other law or regulation regarding its issue, form or content; or
(b) the issuer may have violated laws regulating the conduct of his business; or
(c) the goods covered by the document were owned by the bailee at the time the document was issued; or
(d) the person issuing the document does not come within the definition of warehouseman if it purports to be a warehouse receipt.
