(1) The director may issue and serve any person regulated by this chapter with a written notice of charges and intent to issue a cease and desist order if, in the opinion of the director, the person has committed or is about to commit:

Washington Code 31.12.005
  • Person: means an organization or a natural person including, but not limited to, a sole proprietorship. See Washington Code 31.12.005
  • Unsafe or unsound practice: means any action, or lack of action, which is contrary to generally accepted standards of prudent operation, the likely consequences of which, if continued, would be abnormal risk of loss or danger to a credit union, its members, or an organization insuring or guaranteeing its shares and deposits. See Washington Code 31.12.005
  • (a) A material violation of law; or
    (b) An unsafe or unsound practice.
    (2) Upon taking effect, the order may require the person and its directors, supervisory committee members, officers, employees, and agents to cease and desist from the violation or practice and may require them to take affirmative action to correct the conditions resulting from the violation or practice.
