(1) A driver’s license or identicard issued with the design features required in RCW 46.20.192 may not be used as evidence of or as a basis to infer an individual’s citizenship or immigration status for any purpose.
Terms Used In Washington Code 46.20.1921
- Arrest: Taking physical custody of a person by lawful authority.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- person: may be construed to include the United States, this state, or any state or territory, or any public or private corporation or limited liability company, as well as an individual. See Washington Code 1.16.080
(2) The presence of the design features required in RCW 46.20.192 on a person‘s driver’s license or identicard may not be used as a basis for the criminal investigation, arrest, or detention of that person in circumstances where a person with a driver’s license or identicard without these design features would not be criminally investigated, arrested, or detained.
