A user or generator may appeal from a department order or a surcharge under RCW 70A.214.130 to the pollution control hearings board pursuant to chapter 43.21B RCW.

Terms Used In Washington Code 70A.214.140
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Department: means the department of ecology. See Washington Code 70A.214.020
