Except for actions of the council under chapter 80.50 RCW, all proposals for legislation and other actions of any branch of government of this state, including state agencies, municipal and public corporations, and counties, to the extent the legislation or other action involved approves, authorizes, permits, or establishes procedures solely for approving, authorizing or permitting, the location, financing or construction of any energy facility subject to certification under chapter 80.50 RCW, shall be exempt from the “detailed statement” required by RCW 43.21C.030. Nothing in this section shall be construed as exempting any action of the council from any provision of chapter 43.21C RCW.
Terms Used In Washington Code 80.50.180
- Certification: means a binding agreement between an applicant and the state which shall embody compliance to the siting guidelines, in effect as of the date of certification, which have been adopted pursuant to RCW 80. See Washington Code 80.50.020
- Construction: means on-site improvements, excluding exploratory work, which cost in excess of two hundred fifty thousand dollars. See Washington Code 80.50.020
- Council: means the energy facility site evaluation council created by RCW 80. See Washington Code 80.50.020
- Energy facility: means an energy plant or transmission facilities: PROVIDED, That the following are excluded from the provisions of this chapter:
