Terms Used In Washington Code > Chapter 27.12 - Public libraries

  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Governmental unit: means any county, city, town, rural county library district, intercounty rural library district, rural partial-county library district, or island library district;

  • Intercounty rural library district: means a municipal corporation organized to provide library service for all areas outside of incorporated cities and towns within two or more counties: PROVIDED, That any city or town meeting the population requirements of RCW 27. See Washington Code 27.12.010
  • Island library district: means a municipal corporation organized to provide library service for all areas outside of incorporated cities and towns on a single island only, and not all of the area of the county, in counties composed entirely of islands and having a population of less than twenty-five thousand at the time the island library district was created: PROVIDED, That any city or town meeting the population requirements of RCW 27. See Washington Code 27.12.010
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legislative body: means the body authorized to determine the amount of taxes to be levied in a governmental unit; in rural county library districts, in intercounty rural library districts, and in island library districts, the legislative body shall be the board of library trustees of the district;

  • Library: means a free public library supported in whole or in part with money derived from taxation;

  • Regional library: means a free public library maintained by two or more counties or other governmental units as provided in RCW 27. See Washington Code 27.12.010
  • Rural county library district: means a library serving all the area of a county not included within the area of incorporated cities and towns: PROVIDED, That any city or town meeting the population requirements of RCW 27. See Washington Code 27.12.010
  • Rural partial-county library district: means a municipal corporation organized to provide library service for a portion of the unincorporated area of a county. See Washington Code 27.12.010
  • Statute: A law passed by a legislature.
  • Trustee: A person or institution holding and administering property in trust.
