The board may continue payments of a surviving spouse's entitlement in full to any dependent child who continues to be dependent by reason of mental or physical incapacity as determined by the board, notwithstanding the age of the dependent child or other provisions of this article.
Terms Used In West Virginia Code 15-2A-18
- Board: means the Consolidated Public Retirement Board created pursuant to §. See West Virginia Code 15-2A-2
- Dependent: A person dependent for support upon another.
- Dependent child: means any unmarried child or children born to or adopted by a member or retirant of the fund who:
(A) Is under the age of 18. See West Virginia Code 15-2A-2
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
