(a) The board may, on its own motion, conduct an investigation to determine whether there are any grounds for disciplinary action against a licensee, permittee or certificate of authorization holder. Terms Used In West Virginia Code 30-22-24

  • Board: means the West Virginia Board of Landscape Architects. See West Virginia Code 30-22-4
  • Certificate of authorization: means a certificate issued under the provisions of this article to a firm providing landscape architectural services. See West Virginia Code 30-22-4
  • Certificate of authorization holder: means a firm certified under the provisions of this article to provide landscape architectural services. See West Virginia Code 30-22-4
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Licensee: means a person holding a landscape architecture license issued under the provisions of this article. See West Virginia Code 30-22-4
  • Permittee: means a person holding a temporary permit. See West Virginia Code 30-22-4
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.

(b) Upon receipt of a written complaint filed against any licensee, permittee or certificate of authorization holder, the board shall provide a copy of the complaint to the licensee, permittee or certificate of authorization holder.

(c) If the board finds, upon investigation, that probable cause exists that the licensee, permittee or certificate of authorization holder has violated any provision of this article or the rules promulgated hereunder, then the board shall serve the licensee, permittee or certificate of authorization holder with a written statement of charges and a notice specifying the date, time and place of the hearing. The hearing shall be held in accordance with the provisions of this article.
