Terms Used In West Virginia Code > Chapter 21 > Article 5C - Minimum Wage and Maximum Hours Standards for Employees

  • Amusement park: means any person or organization which holds a permit for the operation of an amusement ride or amusement attraction under §. See West Virginia Code 21-5C-1
  • Commissioner: means the Commissioner of Labor or his or her duly authorized representatives. See West Virginia Code 21-5C-1
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Dependent: A person dependent for support upon another.
  • Employ: means to hire or permit to work. See West Virginia Code 21-5C-1
  • Employee: includes any individual employed by an employer but shall not include: (1) Any individual employed by the United States. See West Virginia Code 21-5C-1
  • Employer: includes the State of West Virginia, its agencies, departments, and all its political subdivisions, any individual, partnership, association, public or private corporation, or any person or group of persons acting directly or indirectly in the interest of any employer in relation to an employee. See West Virginia Code 21-5C-1
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Hours worked: means the hours for which an employee is employed: Provided, That in determining hours worked for the purposes of §. See West Virginia Code 21-5C-1
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Judgment: includes decrees and orders for the payment of money, or the conveyance or delivery of land or personal property, or some interest therein, or any undertaking, bond or recognizance which has the legal effect of a judgment. See West Virginia Code 2-2-10
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Offense: includes every act or omission for which a fine, forfeiture, or punishment is imposed by law. See West Virginia Code 2-2-10
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means one or more individuals. See West Virginia Code 21-3A-2
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
  • Testify: Answer questions in court.
  • Trustee: A person or institution holding and administering property in trust.
  • Wage: means compensation due an employee by reason of his or her employment. See West Virginia Code 21-5C-1
  • Wage and hour director: means the wage and hour director appointed by the Commissioner of Labor as Chief of the Wage and Hour Division. See West Virginia Code 21-5C-1
