Terms Used In West Virginia Code > Chapter 29 > Article 6 - Civil Service System
- Administrator: means any person who fills a statutorily created position within or related to an agency or board (other than a board member) and who is designated by statute as commissioner, deputy commissioner, assistant commissioner, director, chancellor, chief, executive director, executive secretary, superintendent, deputy superintendent or other administrative title, however designated. See West Virginia Code 29-6-2
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Agency: means any administrative unit of state government, including any authority, board, bureau, commission, committee, council, division, section or office. See West Virginia Code 29-6-2
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appointing authority: means a person or group of persons authorized by an agency to make appointments to positions in the classified or classified-exempt service. See West Virginia Code 29-6-2
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Board: means the state Personnel Board created by section six of this article. See West Virginia Code 29-6-2
- Classification plan: means the plan by which positions in the classified service and classified-exempt service have been allocated by class. See West Virginia Code 29-6-2
- Classified service: means an employee whose job satisfies the definitions for "class" and "classify" and who is covered under the civil service system. See West Virginia Code 29-6-2
- Classified-exempt service: means an employee whose position satisfies the definitions for "class" and "classify" but who is not covered under the civil service system or employed by the higher education governing boards. See West Virginia Code 29-6-2
- commission: when used in this article, shall refer to and mean the state personnel board. See West Virginia Code 29-6-9
- Conviction: A judgement of guilt against a criminal defendant.
- Director: means the head of the Division of Personnel as appointed by section seven of this article. See West Virginia Code 29-6-2
- Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
- Division: means the Division of Personnel herein created. See West Virginia Code 29-6-2
- Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Ex officio: Literally, by virtue of one's office.
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fraud: Intentional deception resulting in injury to another.
- in writing: includes any representation of words, letters, or figures, whether by printing, engraving, writing, or otherwise. See West Virginia Code 2-2-10
- Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Offense: includes every act or omission for which a fine, forfeiture, or punishment is imposed by law. See West Virginia Code 2-2-10
- Position: means a particular job which has been classified based on specifications. See West Virginia Code 29-6-2
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Quorum: The number of legislators that must be present to do business.
- Secretary: means the Secretary of the Department of Administration created in section two, article one, chapter . See West Virginia Code 29-6-2
- State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
- Statute: A law passed by a legislature.
- Subpoena: A command to a witness to appear and give testimony.
- Testify: Answer questions in court.
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Veteran: means any person who has served in the Armed Forces of the United States of America during World War I (April 6, 1917--November 11, 1918), World War II (December 7, 1941--December 31, 1946), the Korean Conflict (June 27, 1950--January 31, 1955), the Vietnam Conflict (August 5, 1964--May 7, 1975) or in a campaign, expedition or conflict for which a campaign badge has been authorized and received by such person and who has received a discharge under honorable conditions from such service.
