Terms Used In West Virginia Code > Chapter 47 > Article 11E - Physicians Freedom of Practice Act
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Contract: A legal written agreement that becomes binding when signed.
- Contract: means a written agreement between a physician and an employer. See West Virginia Code 47-11E-1
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Covenant not to compete: means any contract that restricts the right of a physician to practice medicine in any geographic area of the state for any period of time following the expiration of the physician&rsquo. See West Virginia Code 47-11E-1
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Employer: means any person employing at least one individual in the state or any agent of an employer employing at least one individual in the state. See West Virginia Code 47-11E-1
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: means any individual, proprietorship, partnership, firm, association, corporation, labor organization, limited liability corporation or any other legal entity. See West Virginia Code 47-11E-1
- Physician: means a doctor of allopathic or osteopathic medicine who is fully licensed to practice medicine and surgery pursuant to the provisions of either article three or fourteen, chapter thirty of this code. See West Virginia Code 47-11E-1
- State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
