Terms Used In West Virginia Code > Chapter 47 > Article 28 - Prevention of Deceptive Lawsuit Advertising and Solicitation Practices Regarding the Use of Medications

• Conviction: A judgement of guilt against a criminal defendant.
• Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
• Legal advertisement: means a solicitation for legal services regarding the use of medications through television, radio, newspaper or other periodical, outdoor display, or other written, electronic, or recorded communications wherein the advertisement solicits clients or potential clients for legal services. See West Virginia Code 47-28-2
• Person: means an individual or entity, including, but not limited to: (i) Attorneys. See West Virginia Code 47-28-2
• Protected health information: has the meaning given such term in 45 C. See West Virginia Code 47-28-2
• Solicit: means an offer to provide legal services regarding the use of medications by written, recorded, or electronic communication or by in-person, telephone, or real-time electronic contact. See West Virginia Code 47-28-2
• State: when applied to a part of the United States and not restricted by the context, includes the District of Columbia and the several territories, and the words "United States" also include the said district and territories. See West Virginia Code 2-2-10
