Terms Used In West Virginia Code > Chapter 4 > Article 8 - Capitol Building Commission

  • Agricultural products: means horticultural, viticultural, forestry, dairy, livestock, poultry, bee, and any farm products in their natural form or processed. See West Virginia Code 19-4-1
  • Appraisal: A determination of property value.
  • association: means any corporation organized under this article. See West Virginia Code 19-4-1
  • Biosecurity: means measures, actions or precautions taken to prevent the transmission of disease in, among or between free-ranging and captive cervids. See West Virginia Code 19-2H-2
  • Commissioner: means the Commissioner of the West Virginia Department of Agriculture. See West Virginia Code 19-2F-2

  • Identification system: means a process or procedure that allows an individual cervid to be continuously recognized as a unique animal throughout its lifetime. See West Virginia Code 19-2H-2
  • License: means the authorization issued by the department for the operation of a captive cervid farming facility pursuant to this article. See West Virginia Code 19-2H-2
  • Member: means a member of an association without capital stock and a holder of common stock in an association organized with capital stock. See West Virginia Code 19-4-1
  • Owner: means the person who owns or operates a captive cervid farming facility. See West Virginia Code 19-2H-2
  • Person: means an individual, partnership, corporation, association, fiduciary, or other group of persons acting together whether organized or not. See West Virginia Code 19-2F-2
  • Person: means an individual, corporation, limited liability company, partnership, association, joint venture or other legal entity. See West Virginia Code 19-2H-2
  • Producer: means any person in the business of raising, breeding or growing cattle or calves for beef production. See West Virginia Code 19-2F-2
  • Qualified activity: means those engaged in the producing, preserving, harvesting, drying, processing, manufacturing, canning, packing, grading, storing, handling, utilizing, marketing, financing, selling, distributing, shipping, procuring or providing of agricultural products, or other goods and services, or the by-products thereof. See West Virginia Code 19-4-1
  • Release: means to allow a cervid from a licensed captive cervid farming facility to be outside the perimeter fence of that licensed captive cervid farming facility without being under the direct control of the owner or his or her agent. See West Virginia Code 19-2H-2
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • State board: means the West Virginia Board of Education. See West Virginia Code 18-1-1
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
