(a) A person may not deny access to a long term care facility or to a resident of a long term care facility by the ombudsman or an employee, volunteer, or other representative of the office.

Terms Used In Alaska Statutes 44.25.330

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
  • Subpoena: A command to a witness to appear and give testimony.
(b) Notwithstanding the provisions of Alaska Stat. § 44.25.310(c)(1), the ombudsman may obtain medical or other records of a resident of a long term care facility in the state only with the consent of the resident or the person’s resident representative or legal guardian or, if the resident is unable or incompetent to consent and does not have a resident representative, only with a subpoena or court order.
