A. The governor shall commission in the name and by the authority of the state:

Terms Used In Arizona Laws 38-221

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • commission: means any office, board or commission of the state, or any political subdivision thereof, the salary or compensation of the incumbent or members of which is paid from a fund raised by taxation or by public revenue. See Arizona Laws 38-101
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.

1. Officers elected by the electors of the state whose commissions or certificates of election are not otherwise provided for.

2. Officers elected by the legislature.

3. Officers of the militia.

4. Officers appointed by the governor, or by the governor with the advice and consent of the senate.

B. The commission shall be signed by the governor and attested by the secretary of state under the great seal of the state.

C. The commissions of all officers other than those provided for in subsection A of this section, where no special provision is made by law, shall be signed by the presiding officer of the body or person making the appointment.
