  • Accused: means a person who has been arrested for committing a criminal offense and who is held for an initial appearance or other proceeding before trial. See Arizona Laws 13-4401
  • Acquisition of control: means any transaction whereby a person obtains, directly or indirectly, control of a bank, trust company, savings and loan association or controlling person. See Arizona Laws 6-141
  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Act: means a bodily movement. See Arizona Laws 13-105
  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Adjusted gross event wagering receipts: means an event wagering operator's gross wagering receipts, excluding voided bets, minus winnings paid to authorized participants and any federal excise tax. See Arizona Laws 5-1301
  • Administer: means to apply, inject or facilitate the inhalation or ingestion of a substance to the body of a person. See Arizona Laws 13-3401
  • Adult: means a person who has attained eighteen years of age. See Arizona Laws 1-215
  • advertisement: means any message in any medium that offers or solicits any person to engage in sexual conduct in this state. See Arizona Laws 13-3551
  • Advisory board: means the advisory board of the sports authority. See Arizona Laws 5-1101
  • Advisory board: means the advisory board of the authority. See Arizona Laws 5-1401
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amidone: means any substance identified chemically as (4-4-diphenyl-6-dimethylamine-heptanone-3), or any salt of such substance, by whatever trade name designated. See Arizona Laws 13-3401
  • Amusement gambling: means gambling involving a device, game or contest that is played for entertainment if all of the following apply:

    (a) The player or players actively participate in the game or contest or with the device. See Arizona Laws 13-3301

  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Applicant: means any person that has applied for a license as a fantasy sports contest operator or that has been approved for any act related to fantasy sports contests. See Arizona Laws 5-1201
  • Application: means a request to issue a license as a fantasy sports contest operator or to approve any act related to fantasy sports contests. See Arizona Laws 5-1201
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arrest: Taking physical custody of a person by lawful authority.
  • Arrest: means the actual custodial restraint of a person or the person's submission to custody. See Arizona Laws 13-4401
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Associate director: means the associate director of the division. See Arizona Laws 3-201
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney for the state: means an attorney designated by the attorney general, by a county attorney or by a city attorney to investigate, commence and prosecute an action under this chapter. See Arizona Laws 13-4301
  • Authority: means the tourism and sports authority. See Arizona Laws 5-801
  • Authority: means a sports authority established pursuant to this chapter. See Arizona Laws 5-1101
  • Authority: means the southern Arizona sports, tourism and film authority. See Arizona Laws 5-1401
  • Authority board: means the governing board of the sports authority. See Arizona Laws 5-1101
  • Automated teller machine: means an automated device that is established by a bank, savings and loan association or credit union and that facilitates customer-bank communications activities, including taking deposits and disbursing cash drawn against a customer's deposit account or a customer's preapproved loan account, at a location separate from the home office or a branch. See Arizona Laws 6-101
  • Bank: means a corporation that holds a banking permit issued pursuant to chapter 2 of this title. See Arizona Laws 6-101
  • Banking office: means any place of business of the bank at which deposits are received, checks are paid or money is loaned but does not include the premises used for computer operations, proofing, record keeping, accounting, storage, maintenance or other administrative or service functions. See Arizona Laws 6-101
  • Base area lift: means a passenger tramway that skiers ordinarily use without first using another passenger tramway. See Arizona Laws 5-701
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Benefit: means anything of value or advantage, present or prospective. See Arizona Laws 13-105
  • Board: means the Arizona state board of pharmacy. See Arizona Laws 13-3401
  • Board: means the board of directors of the authority. See Arizona Laws 5-801
  • Board: means the board of directors of the authority. See Arizona Laws 5-1401
  • Board of directors: means the county board of supervisors serving as the board of directors of the district. See Arizona Laws 5-1101
  • Bond: means any obligation authorized and issued pursuant to this article, including:

    (a) Bonds and notes. See Arizona Laws 5-1161

  • Bond related expenses: means any expenses incurred by the authority to issue and administer its bonds including underwriting fees and costs, trustee fees, financial consultant fees, printing and advertising costs, paying agent fees, transfer agent fees, legal, accounting, feasibility consultant and other professional fees and expenses, credit enhancement fees, attorney and accounting fees and expenses related to credit enhancement, bond insurance or liquidity enhancement, remarketing fees, rating agency fees and costs, travel and telephone expenses and all other fees considered necessary by the authority in order to market and administer the bonds. See Arizona Laws 5-861
  • Bond-related expenses: means any expenses incurred by the authority for issuing and administering its bonds, including underwriting fees and costs, trustee fees, financial consultant fees, printing and advertising costs, paying agent fees, transfer agent fees, legal fees, accounting fees, feasibility consultant and other professional fees and expenses, credit enhancement fees and expenses related to credit enhancement, bond insurance or liquidity enhancement, remarketing fees, rating agency fees and costs, travel and telephone expenses and all other fees considered necessary by the board in order to market and administer the bonds.   • Bonds: means the bonds of the authority issued pursuant to this article. See Arizona Laws 5-861
  • Branch: means any banking office other than the principal banking office. See Arizona Laws 6-101
  • Bribe: means anything of value or advantage, present or prospective, asked, offered, given, accepted or promised with a corrupt intent to influence, unlawfully, the person to whom it is given in that person's action, vote or opinion, in any public or official capacity. See Arizona Laws 1-215
  • Calendar year: means three hundred sixty-five days' actual time served without release, suspension or commutation of sentence, probation, pardon or parole, work furlough or release from confinement on any other basis. See Arizona Laws 13-105
  • cannabimimetic substances: means any substances within the following structural classes:

    (i) 2-(3-hydroxycyclohexyl)phenol with substitution at the 5-position of the phenolic ring by alkyl or alkenyl, whether or not substituted on the cyclohexyl ring to any extent. See Arizona Laws 13-3401

  • Cannabis: means the following substances under whatever names they may be designated:

    (a) The resin extracted from any part of a plant of the genus cannabis, and every compound, manufacture, salt, derivative, mixture or preparation of such plant, its seeds or its resin. See Arizona Laws 13-3401

  • Chair lift: means a type of transportation on which passengers are carried on chairs suspended in the air and attached to a moving cable, chain or link belt supported by trestles or towers with one or more spans. See Arizona Laws 5-701
  • Chambers: A judge's office.
  • Circumstantial evidence: All evidence except eyewitness testimony.
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Clinical liaison: means a mental health expert or any other individual who has experience and training in mental health or developmental disabilities and who is qualified and appointed by the court to aid in coordinating the treatment or training of individuals who are found incompetent to stand trial. See Arizona Laws 13-4501
  • Coca leaves: means cocaine, its optical isomers and any compound, manufacture, salt, derivative, mixture or preparation of coca leaves, except derivatives of coca leaves which do not contain cocaine, ecgonine or substances from which cocaine or ecgonine may be synthesized or made. See Arizona Laws 13-3401
  • Commercially reasonable: means a sale or disposal that would be commercially reasonable under Title 47, Chapter 9, Article 6. See Arizona Laws 13-4301
  • Commission: means the Arizona state lottery commission. See Arizona Laws 5-551
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Community supervision: means that portion of a felony sentence that is imposed by the court pursuant to section 13-603, subsection I and that is served in the community after completing a period of imprisonment or served in prison in accordance with Section 41-1604. See Arizona Laws 13-105
  • Competitor: means a skier actually engaged in competition or in practice for competition with the permission of a ski area operator on any slope or trail or portion of any slope or trail designated for competition by the ski area operator. See Arizona Laws 5-701
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conditions of ordinary visibility: means daylight and, if applicable, nighttime in nonprecipitating weather. See Arizona Laws 5-701
  • Conduct: means an act or omission and its accompanying culpable mental state. See Arizona Laws 13-105
  • Conducted as a business: means gambling that is engaged in with the object of gain, benefit or advantage, either direct or indirect, realized or unrealized, but not if incidental to a bona fide social relationship. See Arizona Laws 13-3301
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Control: means direct or indirect ownership of or power to vote twenty-five percent or more of the outstanding voting securities of a bank, trust company, savings and loan association or controlling person or to control in any manner the election of a majority of the directors of a bank, trust company, savings and loan association or controlling person. See Arizona Laws 6-141
  • Controlled substance: means a drug, substance or immediate precursor in schedules I through V of Title 36, Chapter 27 or the rules adopted pursuant to Title 36, Chapter 27, or a dangerous drug or a narcotic drug listed in section 13-3401. See Arizona Laws 13-3451
  • Controlling person: means any person directly or indirectly in control of a bank, trust company or savings and loan association. See Arizona Laws 6-141
  • Converting bank: means a bank converting from a national to a state bank, or the reverse. See Arizona Laws 6-211
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Counterfeit preparation: means a preparation that has an appearance which imitates another preparation but that, in fact, is a different preparation. See Arizona Laws 13-3451
  • Court: means all state, county and municipal courts in this state. See Arizona Laws 13-4401
  • Crane game: means an amusement machine that is operated by player controlled buttons, control sticks or other means, or a combination of the buttons or controls, which is activated by coin insertion into the machine and where the player attempts to successfully retrieve prizes with a mechanical or electromechanical claw or device by positioning the claw or device over a prize. See Arizona Laws 13-3301
  • Crime: means a misdemeanor or a felony. See Arizona Laws 13-105
  • Crime victim advocate: means a person who is employed or authorized by a public or private entity to provide counseling, treatment or other supportive assistance to crime victims. See Arizona Laws 13-4401
  • Criminal negligence: means , with respect to a result or to a circumstance described by a statute defining an offense, that a person fails to perceive a substantial and unjustifiable risk that the result will occur or that the circumstance exists. See Arizona Laws 13-105
  • Criminal offense: means conduct that gives a peace officer or prosecutor probable cause to believe that a felony, a misdemeanor, a petty offense or a violation of a local criminal ordinance has occurred. See Arizona Laws 13-4401
  • Criminal proceeding: means any hearing, argument or other matter that is scheduled by and held before a trial court but does not include any deposition, lineup, grand jury proceeding or other matter that is not held in the presence of the court. See Arizona Laws 13-4401
  • crop: includes every kind of vegetation, wild or domesticated, and any part thereof, as well as seed, fruit or other natural product of such vegetation. See Arizona Laws 3-201
  • Custodial agency: means any law enforcement officer or agency, a sheriff or municipal jailer, the state department of corrections or a secure mental health facility that has custody of a person who is arrested or in custody for a criminal offense. See Arizona Laws 13-4401
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dangerous: means that, as a result of a mental illness, defect or disability, a person's continued behavior can reasonably be expected, on the basis of a mental health expert's opinion, to result in serious physical harm or death to another person. See Arizona Laws 13-4501
  • Dangerous drug: means dangerous drug as defined in section 13-3401. See Arizona Laws 13-105
  • Dangerous drug: means the following by whatever official, common, usual, chemical or trade name designated:

    (a) Any material, compound, mixture or preparation that contains any quantity of the following hallucinogenic substances and their salts, isomers, whether optical, positional or geometric, and salts of isomers, unless specifically excepted, whenever the existence of such salts, isomers and salts of isomers is possible within the specific chemical designation:

    (i) Alpha-ethyltryptamine. See Arizona Laws 13-3401

  • Dangerous instrument: means anything that under the circumstances in which it is used, attempted to be used or threatened to be used is readily capable of causing death or serious physical injury. See Arizona Laws 13-105
  • Dangerous offense: means an offense involving the discharge, use or threatening exhibition of a deadly weapon or dangerous instrument or the intentional or knowing infliction of serious physical injury on another person. See Arizona Laws 13-105
  • Deadly weapon: means anything designed for lethal use, including a firearm. See Arizona Laws 13-105
  • Deadly weapon: means anything that is designed for lethal use. See Arizona Laws 13-3101
  • Decedent: A deceased person.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Defendant: means a person or entity that is formally charged by complaint, indictment or information of committing a criminal offense. See Arizona Laws 13-4401
  • Defense attorney: Represent defendants in criminal matters.
  • Deliver: means the actual, constructive or attempted exchange from one person to another, whether or not there is an agency relationship. See Arizona Laws 13-3401
  • Department: means the Arizona department of agriculture. See Arizona Laws 3-101
  • Department: means the department of insurance and financial institutions. See Arizona Laws 6-101
  • Department: means the department of gaming. See Arizona Laws 5-1201
  • Department: means the department of gaming. See Arizona Laws 5-1301
  • Dependent: A person dependent for support upon another.
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Deputy director: means the deputy director of the financial institutions division of the department. See Arizona Laws 6-101
  • Devise: To gift property by will.
  • Director: means the director of the department of health services. See Arizona Laws 13-3401
  • Director: means the executive director of the Arizona state lottery commission. See Arizona Laws 5-551
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Diseases: includes any fungus, bacterium, virus or other organism of any kind and any unknown cause that is or may be found to be injurious, or likely to be or to become injurious to any domesticated or cultivated plant, or to the product of any such plant. See Arizona Laws 3-201
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Distribute: means the actual, constructive or attempted transfer, delivery or sale of, or dispensing to another of, an imitation controlled substance, imitation prescription-only drug or imitation over-the-counter drug. See Arizona Laws 13-3451
  • District: means a sports authority district established pursuant to this chapter. See Arizona Laws 5-1101
  • Division: means the financial institutions division within the department. See Arizona Laws 6-101
  • Division: means the plant services division of the Arizona department of agriculture. See Arizona Laws 3-201
  • Docket: A log containing brief entries of court proceedings.
  • Donor: The person who makes a gift.
  • Drug court program: means a program that is established pursuant to section 13-3422 by the presiding judge of the superior court in cooperation with the county attorney in a county for the purpose of prosecuting, adjudicating and treating drug dependent persons who meet the criteria and guidelines for entry into the program that are developed and agreed on by the presiding judge and the prosecutor.   • E-sport: means an organized, multiplayer video game competition, particularly between professional players, individually or as teams. See Arizona Laws 5-1301
  • Economic loss: means any loss incurred by a person as a result of the commission of an offense. See Arizona Laws 13-105
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Employee: means a person who conducts lawful or unlawful business for another person under a master-servant relationship or as an independent contractor and who is compensated by wages, commissions, tips or other valuable consideration. See Arizona Laws 13-3211
  • Enterprise: includes any corporation, association, labor union or other legal entity. See Arizona Laws 13-105
  • Enterprise: means any person under the jurisdiction of the department other than a financial institution. See Arizona Laws 6-101
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entry fee: means cash or cash equivalent that is paid by a participant to a fantasy sports contest operator to participate in a fantasy sports contest. See Arizona Laws 5-1201
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • escape: means :

    (i) A departure from custody or from a juvenile secure care facility, a juvenile detention facility or an adult correctional facility in which the person is held or detained, with knowledge that the departure is not allowed, or the failure to return to custody or detention following a temporary leave granted for a specific purpose or for a limited period. See Arizona Laws 13-105

  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Event wagering employee: means an employee of an event wagering operator, sports facility, management services provider or limited event wagering operator who is directly involved in the management or control of the conduct of event wagering under this chapter in this state. See Arizona Laws 5-1301
  • Event wagering facility: means a facility at which event wagering is conducted under this chapter. See Arizona Laws 5-1301
  • Event wagering operator: means either:

    (a) An owner or operator of an Arizona professional sports team or franchise, an operator of a sports facility in this state that hosts an annual tournament on the PGA tour or a promoter of a national association for stock car auto racing national touring race in this state, or the designee of such an owner, operator or promoter, who is licensed to offer event wagering under this chapter. See Arizona Laws 5-1301

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Executor: A male person named in a will to carry out the decedent
  • Exploitive exhibition: means the actual or simulated exhibition of the genitals or pubic or rectal areas of any person for the purpose of sexual stimulation of the viewer. See Arizona Laws 13-3551
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Fantasy sports contest: means a simulated game or contest that is offered to the public with an entry fee and that meets all of the following conditions:

    (a) No fantasy sports contest team is composed of the entire roster of a real-world sports team. See Arizona Laws 5-1201

  • Fantasy sports contest adjusted revenues: means the amount equal to the total of all entry fees that a fantasy sports contest operator collects from all fantasy sports contest players minus the total of all sums paid out as prizes or awards to all fantasy sports contest players, multiplied by the in-state percentage. See Arizona Laws 5-1201
  • Fantasy sports contest platform: means the hardware, software, firmware, communications technology or other equipment, including operator procedures implemented to allow player participation in digital or online fantasy sports contests, and if supported, the corresponding equipment related to the display of the outcomes, and other similar information necessary to facilitate player participation in which a player is provided with the means to establish a player account and the fantasy sports contest operator is provided with the means to review player accounts, suspend fantasy sports contests, generate various financial transaction and account reports, input outcomes for fantasy sports contests and set any configurable parameters.   • Fantasy sports contest team: means the simulated team composed of multiple individual athletes, each of whom is a member of a real-world sports team that a fantasy sports contest player selects to compete in a fantasy sports contest. See Arizona Laws 5-1201
  • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Federal deposit insurance corporation: includes any successor to the corporation or other agency or instrumentality of the United States that undertakes to discharge the purposes of the corporation. See Arizona Laws 6-101
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
  • Felony: means an offense for which a sentence to a term of imprisonment in the custody of the state department of corrections is authorized by any law of this state. See Arizona Laws 13-105
  • Fiduciary: A trustee, executor, or administrator.
  • Final disposition: means the ultimate termination of the criminal prosecution of a defendant by a trial court, including dismissal, acquittal or imposition of a sentence. See Arizona Laws 13-4401
  • Financial institution: means banks, trust companies, savings and loan associations, credit unions, consumer lenders, international banking facilities and financial institution holding companies under the jurisdiction of the department. See Arizona Laws 6-101
  • Firearm: means any loaded or unloaded handgun, pistol, revolver, rifle, shotgun or other weapon that will or is designed to or may readily be converted to expel a projectile by the action of expanding gases, except that it does not include a firearm in permanently inoperable condition. See Arizona Laws 13-105
  • Firearm: means any loaded or unloaded handgun, pistol, revolver, rifle, shotgun or other weapon that will expel, is designed to expel or may readily be converted to expel a projectile by the action of an explosive. See Arizona Laws 13-3101
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Forbearance: A means of handling a delinquent loan. A
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Government: means the state, any political subdivision of the state or any department, agency, board, commission, institution or governmental instrumentality of or within the state or political subdivision. See Arizona Laws 13-105
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Harmful to minors: means that quality of any description or representation, in whatever form, of nudity, sexual activity, sexual conduct, sexual excitement, or sadomasochistic abuse, when both:

    (a) To the average adult applying contemporary state standards with respect to what is suitable for minors, it both:

    (i) Appeals to the prurient interest, when taken as a whole. See Arizona Laws 13-3501

  • Highly experienced player: means a fantasy sports contest player who has done at least one of the following:

    (a) Entered more than one thousand fantasy sports contests offered by a single fantasy sports contest operator. See Arizona Laws 5-1201

  • Historical prior felony conviction: means :

    (a) Any prior felony conviction for which the offense of conviction either:

    (i) Mandated a term of imprisonment except for a violation of chapter 34 of this title involving a drug below the threshold amount. See Arizona Laws 13-105

  • Holding company: means a corporation, firm, partnership, limited partnership, limited liability company, trust or other form of business organization that is not an individual and that directly or indirectly does either of the following:

    (a) Holds an ownership interest of ten percent or more, as determined by the holding company's board, in a fantasy sports contest operator. See Arizona Laws 5-1201

  • Home state: means the state that has granted the bank its charter, permit or license to operate. See Arizona Laws 6-101
  • House of prostitution: means any building, structure or place that is used for the purpose of prostitution or lewdness or where acts of prostitution occur. See Arizona Laws 13-3211
  • Imitation controlled substance: means a drug, substance or immediate precursor which does or does not contain a controlled substance that by texture, consistency or color or dosage unit appearance as evidenced by color, shape, size or markings, apart from any other representations, packaging or advertisements, would lead a reasonable person to believe that the substance is a controlled substance but it is a counterfeit preparation. See Arizona Laws 13-3451
  • Imitation over-the-counter drug: means an imitation of a nonprescription drug as defined in section 32-1901 that by texture, consistency or color or dosage unit appearance as evidenced by color, shape, size or markings, apart from any other representations, packaging or advertisements, would lead a reasonable person to believe that the substance is an over-the-counter drug. See Arizona Laws 13-3451
  • Imitation prescription-only drug: means a drug, substance or immediate precursor which does or does not contain a prescription-only drug as defined by section 32-1901 that by texture, consistency or color or dosage unit appearance as evidenced by color, shape, size or markings, apart from any other representations, packaging or advertisements, would lead a reasonable person to believe that the substance is a prescription-only drug but it is a counterfeit preparation. See Arizona Laws 13-3451
  • Immediate family: means a victim's spouse, parent, child, sibling, grandparent or lawful guardian. See Arizona Laws 13-4401
  • In-state financial institution: means a state or federal bank, savings bank, savings and loan association or holding company with its home office located in this state. See Arizona Laws 6-101
  • In-state financial institution: means a state or national bank or savings and loan association with its home office in this state, or holding company with its home office in this state. See Arizona Laws 6-211
  • In-state percentage: means for each fantasy sports contest, the percentage, rounded to the nearest tenth of a percent, equal to the total entry fees collected from all in-state participants divided by the total entry fees collected from all participants in the fantasy sports contest, unless otherwise prescribed by the department. See Arizona Laws 5-1201
  • including: means not limited to and is not a term of exclusion. See Arizona Laws 1-215
  • Incompetent to stand trial: means that as a result of a mental illness, defect or disability a defendant is unable to understand the nature and object of the proceeding or to assist in the defendant's defense. See Arizona Laws 13-4501
  • Indian tribe: means any organized Indian nation, tribe, band or community that is recognized as an Indian tribe by the United States department of the interior. See Arizona Laws 5-801
  • Indian tribe: means any organized Indian nation, tribe, band or community that is recognized as an Indian tribe by the United States department of the interior. See Arizona Laws 5-1401
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • infrastructure: means improvements that will directly and principally benefit the stadium or multipurpose facility and includes:

    (i) Sanitary sewage systems. See Arizona Laws 5-1161

  • infrastructure: means improvements that will directly and principally benefit the multipurpose facility and includes:

    (i) Sanitary sewage systems. See Arizona Laws 5-1461

  • Inherent dangers and risks of skiing: means those dangers or conditions that are an integral part of the sport of skiing, excluding acts of ordinary or gross negligence, or reckless or intentional conduct on the part of the ski area operator. See Arizona Laws 5-701
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Injured person: means a person who has sustained economic loss, including medical loss, as a result of injury to his person, business or property by the conduct giving rise to the forfeiture of property, and who is not an owner of or an interest holder in the property. See Arizona Laws 13-4301
  • Interest holder: means a person in whose favor there is a security interest or who is the beneficiary of a perfected encumbrance pertaining to an interest in property. See Arizona Laws 13-4301
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • International banking facility: means a facility that is represented by a set of asset and liability accounts segregated on the books and records of a commercial bank, the principal office of which is located in this state, and that is incorporated and doing business under the laws of the United States or of this state, a United States branch or agency of a foreign bank, an edge corporation organized under section 25(a) of the federal reserve act (12 United States Code §§ 611 through 631) or an agreement corporation having an agreement or undertaking with the board of governors of the federal reserve system under section 25 of the federal reserve act (12 United States Code §§ 601 through 604(a)) that includes only international banking facility time deposits and international banking facility extensions of credit as defined in Title 12 of the Code of Federal Regulations, Part 204. See Arizona Laws 6-101
  • Isoamidone: means any substance identified chemically as (4-4-diphenyl-5-methyl-6-dimethylaminohexanone-3), or any salt of such substance, by whatever trade name designated. See Arizona Laws 13-3401
  • Item: means any material or performance which depicts or describes sexual activity and includes any book, leaflet, pamphlet, magazine, booklet, picture, drawing, photograph, film, negative, slide, motion picture, figure, object, article, novelty device, recording, transcription, live or recorded telephone message or other similar items whether tangible or intangible and including any performance, exhibition, transmission or dissemination of any of the above. See Arizona Laws 13-3501
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Ketobemidone: means any substance identified chemically as (4-(3-hydroxyphenyl)-1-methyl-4-piperidylethyl ketone hydrochloride), or any salt of such substance, by whatever trade name designated. See Arizona Laws 13-3401
  • Key employee: means an employee of a fantasy sports contest operator who has the power to exercise significant influence over decisions concerning the fantasy sports contest operator. See Arizona Laws 5-1201
  • Knowingly: means , with respect to conduct or to a circumstance described by a statute defining an offense, that a person is aware or believes that the person's conduct is of that nature or that the circumstance exists. See Arizona Laws 13-105
  • Knowledge of the character: means having general knowledge or awareness, or reason to know, or a belief or ground for belief which warrants further inspection or inquiry of that which is reasonably susceptible to examination by the defendant both:

    (a) That the item contains, depicts or describes nudity, sexual activity, sexual conduct, sexual excitement or sadomasochistic abuse, whichever is applicable, whether or not there is actual knowledge of the specific contents thereof. See Arizona Laws 13-3501

  • Lawful representative: means a person who is designated by the victim or appointed by the court and who acts in the best interests of the victim. See Arizona Laws 13-4401
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means an approval that is issued by the department to any person or entity to be involved in a fantasy sports operation. See Arizona Laws 5-1201
  • Licensee: means a person that holds an event wagering operator license, limited event wagering license, supplier license or management services provider license. See Arizona Laws 5-1301
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Limited event wagering operator: means a racetrack enclosure or additional wagering facility that holds a permit issued by the division of racing to offer wagers on horseracing and that is licensed under this chapter. See Arizona Laws 5-1301
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Magistrate: means an officer having power to issue a warrant for the arrest of a person charged with a public offense and includes the chief justice and justices of the supreme court, judges of the superior court, judges of the court of appeals, justices of the peace and judges of a municipal court. See Arizona Laws 1-215
  • Management company: means a person retained by a fantasy sports contest operator to manage a fantasy sports contest platform and provide general administration and other operational services. See Arizona Laws 5-1201
  • Management services provider: means a person that operates, manages or controls event wagering authorized by this chapter on behalf of an event wagering operator or limited event wagering operator, including developing or operating event wagering platforms and providing odds, lines and global risk management, and may provide services to more than one licensed event wagering operator or licensed limited event wagering operator. See Arizona Laws 5-1301
  • Manufacture: means produce, prepare, propagate, compound, mix or process, directly or indirectly, by extraction from substances of natural origin or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis. See Arizona Laws 13-3401
  • Manufacture: means the production, preparation, compounding, processing, encapsulating, packaging or repackaging, or labeling or relabeling of an imitation controlled substance, imitation prescription-only drug or imitation over-the-counter drug. See Arizona Laws 13-3451
  • Manufacturer: means a person who manufactures a narcotic or dangerous drug or other substance controlled by this chapter. See Arizona Laws 13-3401
  • Marijuana: means all parts of any plant of the genus cannabis, from which the resin has not been extracted, whether growing or not, and the seeds of such plant. See Arizona Laws 13-3401
  • Mental health expert: means a physician who is licensed pursuant to Title 32, Chapter 13 or 17 or a psychologist who is licensed pursuant to Title 32, Chapter 19. See Arizona Laws 13-4501
  • Merger: includes consolidation. See Arizona Laws 6-211
  • Minor: means a person or persons who were under eighteen years of age at the time a visual depiction was created, adapted or modified. See Arizona Laws 13-3551
  • Minor: means a person under eighteen years of age. See Arizona Laws 1-215
  • Misdemeanor: means an offense for which a sentence to a term of imprisonment other than to the custody of the state department of corrections is authorized by any law of this state. See Arizona Laws 13-105
  • mixture: means any combination of substances from which the unlawful substance cannot be removed without a chemical process. See Arizona Laws 13-3401
  • Month: means a calendar month unless otherwise expressed. See Arizona Laws 1-215
  • Moral turpitude: means an offense, whether a misdemeanor or felony, that is related to extortion, burglary, larceny, bribery, embezzlement, robbery, racketeering, money laundering, forgery, fraud, murder, voluntary manslaughter or a sexual offense that requires the individual to register pursuant to section 13-3821. See Arizona Laws 1-215
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Multipurpose facility: means any facility that is suitable to be used to accommodate professional football franchises, major college football bowl sponsors, other sporting events and entertainment, cultural, civic, meeting, trade show or convention events or activities and may include a stadium, on-site infrastructure, parking garages and lots and related commercial uses within the facility. See Arizona Laws 5-801
  • Multipurpose facility: means a stadium or a facility for youth sports that is adapted for additional entertainment, cultural, civic, meeting, trade show or convention events, on-site infrastructure and related parking facilities and commercial activity within the facility. See Arizona Laws 5-1101
  • Multipurpose facility purpose: includes the following purposes:

    (a) Acquiring, designing, developing, constructing, reconstructing, equipping, repairing, maintaining, operating and improving a multipurpose facility and improvements. See Arizona Laws 5-861

  • Narcotic drug: means narcotic drugs as defined in section 13-3401. See Arizona Laws 13-105
  • Narcotic drugs: means the following, whether of natural or synthetic origin and any substance neither chemically nor physically distinguishable from them:

    (a) Acetyl-alpha-methylfentanyl. See Arizona Laws 13-3401

  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • National bank: means a national banking association located in this state. See Arizona Laws 6-211
  • Nighttime: means the period between sunset and sunrise. See Arizona Laws 1-215
  • Noxious weed: means any species of plant that is, or is liable to be, detrimental or destructive and difficult to control or eradicate and shall include any species that the director, after investigation and hearing, shall determine to be a noxious weed. See Arizona Laws 3-201
  • Nudity: means the showing of the human male or female genitals, pubic area or buttocks with less than a full opaque covering, or the showing of the female breast with less than a fully opaque covering of any portion thereof below the top of the nipple, or the depiction of covered male genitals in a discernibly turgid state. See Arizona Laws 13-3501
  • Nursery: means real property or other premises on or in which nursery stock is propagated, grown or cultivated or from which source nursery stock is offered for distribution or sale. See Arizona Laws 3-201
  • Nursery stock: includes all trees, shrubs, vines, cacti, agaves, succulents, herbaceous plants whether annuals, biennials or perennials, bulbs, corms, rizomes, roots, decorative plant material, flowers, fruit pits or seeds, cuttings, buds, grafts, scions and other plants intended for sale, gift or propagation, either cultivated or collected in the wild, except seeds as regulated by article 2 of this chapter, fruit and vegetables regulated by chapter 3, articles 2 and 4 of this title and cotton plants. See Arizona Laws 3-201
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Official league data: means statistics, results, outcomes and other data related to a sports event or other event obtained pursuant to an agreement with the relevant sports governing body or an entity expressly authorized by the sports governing body to provide such information to licensees that authorizes the use of such data for determining the outcome of sports wagers on sports events or other events. See Arizona Laws 5-1301
  • Omission: means the failure to perform an act as to which a duty of performance is imposed by law. See Arizona Laws 13-105
  • Operate and maintain: means to organize, design, perpetuate or control. See Arizona Laws 13-3211
  • operator: means a person that is engaged in the business of professionally conducting paid fantasy sports contests for cash or other prizes or awards for members of the general public that requires cash or cash equivalent as an entry fee to be paid by a member of the general public who participates in a paid fantasy sports contest. See Arizona Laws 5-1201
  • Opium: means any compound, manufacture, salt, isomer, salt of isomer, derivative, mixture or preparation of the following, but does not include apomorphine or any of its salts:

    (a) Acetorphine. See Arizona Laws 13-3401

  • Oral sexual contact: means oral contact with the penis, vulva or anus. See Arizona Laws 13-3211
  • Other event: means a competition of relative skill or an event authorized by the department under this chapter. See Arizona Laws 5-1301
  • Out-of-state bank: means a bank, savings bank or savings and loan association that is approved by the deputy director pursuant to section 6-322 and that has a charter, a permit or any other license to operate that is issued by a state other than this state. See Arizona Laws 6-101
  • Out-of-state financial institution: means a state or federal bank, savings bank, savings and loan association or holding company with its home office in a state other than this state. See Arizona Laws 6-101
  • Out-of-state financial institution: means a state or national bank or savings and loan association with its home office in a state other than this state, or holding company with its home office in a state other than this state. See Arizona Laws 6-211
  • Owner: means a person who is not a secured party as defined in section 47-9102 and who has an interest in property, whether legal or equitable. See Arizona Laws 13-4301
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Passenger tramway: means a device used to transport passengers uphill on skis or in cars on tracks or suspended in the air by the use of steel cables, chains, belts or ropes, usually supported by trestles or towers with one or more spans. See Arizona Laws 5-701
  • Peace officer: means any person vested by law with a duty to maintain public order and make arrests and includes a constable. See Arizona Laws 13-105
  • Peace officers: means sheriffs of counties, constables, marshals, policemen of cities and towns, commissioned personnel of the department of public safety, personnel who are employed by the state department of corrections and the department of juvenile corrections and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a multicounty water conservation district and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by community college district governing boards and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the Arizona board of regents and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the governing body of a public airport pursuant to section 28-8426 and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a private postsecondary institution pursuant to section 15-1897 and who have received a certificate from the Arizona peace officer standards and training board and special agents from the office of the attorney general, or of a county attorney, and who have received a certificate from the Arizona peace officer standards and training board.   • permitted: means authorized by the laws of this state to do certain things. See Arizona Laws 13-3401
  • Person: means a human being and, as the context requires, an enterprise, a public or private corporation, an unincorporated association, a partnership, a firm, a society, a government, a governmental authority or an individual or entity capable of holding a legal or beneficial interest in property. See Arizona Laws 13-105
  • Person: means an individual, partnership, corporation, association, limited liability company, federally recognized Indian tribe or other legal entity. See Arizona Laws 5-1201
  • Person: means an individual, partnership, committee, association, corporation, Indian tribe or an entity fully owned by an Indian tribe, or any other organization or group of persons. See Arizona Laws 5-1301
  • Person: means an individual, corporation, partnership, association, trust or agency or any similar entity. See Arizona Laws 6-141
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Pests: includes all noxious weeds, insects, diseases, mites, spiders, nematodes and other animal or plant organisms found injurious, or likely to be or to become injurious, to any domesticated, cultivated, native or wild plant, or to the product of any such plant. See Arizona Laws 3-201
  • Petty offense: A federal misdemeanor punishable by six months or less in prison. Source: U.S. Courts
  • Petty offense: means an offense for which a sentence of a fine only is authorized by law. See Arizona Laws 13-105
  • Peyote: means any part of a plant of the genus lophophora, known as the mescal button. See Arizona Laws 13-3401
  • Pharmacy: means a licensed business where drugs are compounded or dispensed by a licensed pharmacist. See Arizona Laws 13-3401
  • Physical injury: means the impairment of physical condition. See Arizona Laws 13-105
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Player: means a natural person who participates in gambling. See Arizona Laws 13-3301
  • player: means an individual who participates in a fantasy sports contest offered by a fantasy sports contest operator. See Arizona Laws 5-1201
  • Player account: means an account that is established by a patron for the purpose of participating in fantasy sports contests, including deposits, withdrawals, entry fees and payouts. See Arizona Laws 5-1201
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Plea agreement: An arrangement between the prosecutor, the defense attorney, and the defendant in which the defendant agrees to plead guilty in exchange for special considerations. Source:
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Population: means the population according to the most recent United States decennial census. See Arizona Laws 1-215
  • Possess: means knowingly to have physical possession or otherwise to exercise dominion or control over property. See Arizona Laws 13-105
  • Possession: means a voluntary act if the defendant knowingly exercised dominion or control over property. See Arizona Laws 13-105
  • Post-arrest release: means the discharge of the accused from confinement on recognizance, bond or other condition. See Arizona Laws 13-4401
  • Post-conviction release: means parole, work furlough, community supervision, probation if the court waived community supervision pursuant to section 13-603, home arrest or any other permanent, conditional or temporary discharge from confinement in the custody of the state department of corrections or a sheriff or from confinement in a municipal jail or a secure mental health facility. See Arizona Laws 13-4401
  • Post-conviction relief proceeding: means a contested argument or evidentiary hearing that is held in open court and that involves a request for relief from a conviction or sentence. See Arizona Laws 13-4401
  • Practitioner: means a person licensed to prescribe and administer drugs. See Arizona Laws 13-3401
  • Presentence report: A report prepared by a court's probation officer, after a person has been convicted of an offense, summarizing for the court the background information needed to determine the appropriate sentence. Source: U.S. Courts
  • Prisoner: means a person who has been convicted of a criminal offense against a victim and who has been sentenced to the custody of the sheriff, the state department of corrections, a municipal jail or a secure mental health facility. See Arizona Laws 13-4401
  • Prize or award: means anything of value or any amount of cash or cash equivalents. See Arizona Laws 5-1201
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Process: means a citation, writ or summons issued in the course of judicial proceedings. See Arizona Laws 1-215
  • Produce: means grow, plant, cultivate, harvest, dry, process or prepare for sale. See Arizona Laws 13-3401
  • Producing: means financing, directing, manufacturing, issuing, publishing or advertising for pecuniary gain. See Arizona Laws 13-3551
  • Professional sport: means a sport conducted at the highest level league or organizational play for its respective sport and includes baseball, basketball, football, golf, hockey, soccer and motorsports. See Arizona Laws 5-1301
  • Prohibited conduct: includes any statement, action or other communication intended to unlawfully influence, manipulate or control a betting outcome of a sports event or other event of any individual occurrence or performance in a sports event or other event in exchange for financial gain or to avoid financial or physical harm. See Arizona Laws 5-1301
  • Prohibited participant: means :

    (a) Any individual whose participation may undermine the integrity of the wagering, the sports event or the other event. See Arizona Laws 5-1301

  • Property: means anything of value, tangible or intangible. See Arizona Laws 13-105
  • Property: includes both real and personal property. See Arizona Laws 1-215
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Prostitution: means engaging in or agreeing or offering to engage in sexual conduct under a fee arrangement with any person for money or any other valuable consideration. See Arizona Laws 13-3211
  • Prostitution enterprise: means any corporation, partnership, association or other legal entity or any group of individuals associated in fact although not a legal entity engaged in providing prostitution services. See Arizona Laws 13-3211
  • Protected information: means information related to playing fantasy sports contests by a fantasy sports contest player that is not readily available to the general public and that is obtained as a result of a person's employment in relation to a fantasy sports contest. See Arizona Laws 5-1201
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Recklessly: means , with respect to a result or to a circumstance described by a statute defining an offense, that a person is aware of and consciously disregards a substantial and unjustifiable risk that the result will occur or that the circumstance exists. See Arizona Laws 13-105
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Registered mail: includes certified mail. See Arizona Laws 1-215
  • Regulated chemical: means the following substances in bulk form that are not a useful part of an otherwise lawful product:

    (a) Acetic anhydride. See Arizona Laws 13-3401

  • Regulated gambling: means either:

    (a) Gambling conducted in accordance with a tribal-state gaming compact or otherwise in accordance with the requirements of the Indian gaming regulatory act of 1988 (P. See Arizona Laws 13-3301

  • Release: means no longer in the custody of a custodial agency and includes transfer from one custodial agency to another custodial agency. See Arizona Laws 13-4401
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Resulting bank: means the bank resulting from a merger or conversion. See Arizona Laws 6-211
  • Retailer: means either:

    (a) A person other than a practitioner who sells any precursor chemical or regulated chemical to another person for purposes of consumption and not resale, whether or not the person possesses a permit issued pursuant to Title 32, Chapter 18. See Arizona Laws 13-3401

  • Rights: means any right that is granted to the victim by the laws of this state. See Arizona Laws 13-4401
  • Rope tow: means a mode of transportation that pulls a skier riding on skis as the skier grasps the rope with the skier's hands. See Arizona Laws 5-701
  • Sadomasochistic abuse: means flagellation or torture by or on a person who is nude or clad in undergarments or in revealing or bizarre costume or the condition of being fettered, bound or otherwise physically restrained on the part of one so clothed. See Arizona Laws 13-3211
  • Sadomasochistic abuse: means flagellation or torture by or upon a person clad in undergarments, a mask or bizarre costume, or the condition of being fettered, bound or otherwise physically restrained on the part of one so clothed, for the purpose or in the context of sexual gratification or abuse. See Arizona Laws 13-3501
  • Sale for personal use: means the retail sale for a legitimate medical use in a single transaction to an individual customer, to an employer for dispensing to employees from first aid kits or medicine chests or to a school for administration pursuant to section 15-344. See Arizona Laws 13-3401
  • Script: means a list of commands that a fantasy contest-related computer program can execute and that is created by a fantasy sports contest player or by a third party for a fantasy sports contest player to automate processes on a fantasy sports contest platform. See Arizona Laws 5-1201
  • Seizing agency: means any department or agency of this state or its political subdivisions that regularly employs peace officers and that employs the peace officer who seizes property for forfeiture, or such other agency as the seizing agency may designate in a particular case by its chief executive officer or the chief executive officer's designee. See Arizona Laws 13-4301
  • Seizure for forfeiture: means seizure of property by a peace officer and either:

    (a) There is an assertion by the seizing agency or by an attorney for the state that the property is subject to forfeiture. See Arizona Laws 13-4301

  • sell: means an exchange for anything of value or advantage, present or prospective. See Arizona Laws 13-3401
  • Serious physical injury: includes physical injury that creates a reasonable risk of death, or that causes serious and permanent disfigurement, serious impairment of health or loss or protracted impairment of the function of any bodily organ or limb. See Arizona Laws 13-105
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sexual activity: means :

    (a) Patently offensive representations or descriptions of ultimate sexual acts, normal or perverted, actual or simulated. See Arizona Laws 13-3501

  • Sexual conduct: means acts of masturbation, homosexuality, sexual intercourse, or physical contact with a person's clothed or unclothed genitals, pubic area, buttocks or, if such person is a female, breast. See Arizona Laws 13-3501
  • Sexual conduct: means actual or simulated:

    (a) Sexual intercourse, including genital-genital, oral-genital, anal-genital or oral-anal, whether between persons of the same or opposite sex. See Arizona Laws 13-3551

  • Sexual contact: means any direct or indirect fondling or manipulating of any part of the genitals, anus or female breast. See Arizona Laws 13-3211
  • Sexual excitement: means the condition of human male or female genitals when in a state of sexual stimulation or arousal. See Arizona Laws 13-3501
  • Sexual intercourse: means penetration into the penis, vulva or anus by any part of the body or by any object. See Arizona Laws 13-3211
  • Shipment: includes anything that is brought into the state or that is transported within the state and that may be the host or may contain or carry or may be susceptible of containing, carrying or having present on, in or about it any plant pest or plant disease. See Arizona Laws 3-201
  • Simulated: means any depicting of the genitals or rectal areas that gives the appearance of sexual conduct or incipient sexual conduct. See Arizona Laws 13-3551
  • Site host: means any of the following entities that owns all or part of the multipurpose facility site at the time the site is provided to the authority pursuant to section 5-807:

    (a)  This state or any agency of this state. See Arizona Laws 5-801

  • Ski area: means all ski slopes and trails or other places within the boundary of a ski area operator's property, administered as a single enterprise in this state. See Arizona Laws 5-701
  • Ski area operator: means any corporation, company, partnership, firm, association or other commercial entity, including a natural person, and its employees, agents, members, successors in interest, affiliates and assigns that have responsibility for the operations of a ski area. See Arizona Laws 5-701
  • Ski slopes and trails: means those areas designated by a ski area operator for use by skiers for any of the purposes listed in paragraph 11. See Arizona Laws 5-701
  • Skier: means a person using a ski area for the purpose of skiing or sliding downhill on snow or ice on skis, a toboggan, sled, tube, skibob or snowboard or any other device, using any of the facilities of a ski area, including ski slopes and trails, or observing any activities in a ski area as a sightseer or visitor. See Arizona Laws 5-701
  • Social gambling: means gambling that is not conducted as a business and that involves players who compete on equal terms with each other in a gamble if all of the following apply:

    (a) No player receives, or becomes entitled to receive, any benefit, directly or indirectly, other than the player's winnings from the gamble. See Arizona Laws 13-3301

  • Sports event: means a professional sport or athletic event, a collegiate sport or athletic event, a motor race event, an e-sport event or an olympic event. See Arizona Laws 5-1301
  • Sports facility: means a facility that is owned by a commercial, state or local government or quasi-governmental entity that hosts professional sports events and that holds a seating capacity of more than ten thousand persons at its primary facility, one location in this state that hosts an annual golf tournament on the PGA tour and one location that holds an outdoor motorsports facility that hosts a national association for stock car auto racing national touring race. See Arizona Laws 5-1301
  • Sports governing body: means an organization headquartered in the United States that prescribes final rules and enforces codes of conduct with respect to a sports event and participants in a sports event. See Arizona Laws 5-1301
  • Stadium: means a facility intended primarily for use by one or more major league baseball spring training operations, including baseball stadiums, clubhouses, practice facilities, other related facilities, on-site infrastructure and related parking facilities and commercial activity within the facility. See Arizona Laws 5-1101
  • State bank: means a corporation holding a banking permit under the laws of this state. See Arizona Laws 6-211
  • state lottery: means the lottery created and operated pursuant to this chapter. See Arizona Laws 5-551
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • subscription: includes a mark, if a person cannot write, with the person's name written near it and witnessed by a person who writes the person's own name as witness. See Arizona Laws 1-215
  • Summons: Another word for subpoena used by the criminal justice system.
  • Supplier: means a person that manufactures, distributes or supplies event wagering equipment or software, including event wagering systems. See Arizona Laws 5-1301
  • Surface lift: means a mode of transportation that pulls skiers riding on skis by means of attachment to an overhead cable supported by trestles or towers. See Arizona Laws 5-701
  • Suspicious transaction: means a transaction to which any of the following applies:

    (a) A report is required under the federal act. See Arizona Laws 13-3401

  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Threat to public safety: means charged with the commission of any of the following:

    (a) A crime involving the discharge, use or threatening exhibition of a deadly weapon or dangerous instrument or the infliction of physical injury on another person. See Arizona Laws 13-4501

  • Threshold amount: means a weight, market value or other form of measurement of an unlawful substance as follows:

    (a) One gram of heroin. See Arizona Laws 13-3401

  • Tier one sports wager: means a sports wager that is determined solely by the final score or final outcome of the sports event and that is placed before the sports event has begun. See Arizona Laws 5-1301
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: means furnish, deliver or give away. See Arizona Laws 13-3401
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trustee: A person or institution holding and administering property in trust.
  • Ultimate sexual acts: means sexual intercourse, vaginal or anal, fellatio, cunnilingus, bestiality or sodomy. See Arizona Laws 13-3501
  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • United States: includes the District of Columbia and the territories. See Arizona Laws 1-215
  • Unlawful: means contrary to law or, where the context so requires, not allowed by law. See Arizona Laws 13-105
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Vapor-releasing substance containing a toxic substance: means a material which releases vapors or fumes containing any of the following:

    (a) Ketones, including acetone, methyl ethyl ketone, mibk, miak, isophorone and mesityl oxide. See Arizona Laws 13-3401

  • Vehicle: means a device in, upon or by which any person or property is, may be or could have been transported or drawn upon a highway, waterway or airway, excepting devices moved by human power or used exclusively upon stationary rails or tracks. See Arizona Laws 13-105
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Victim: means a person against whom the criminal offense has been committed, including a minor, or if the person is killed or incapacitated, the person's spouse, parent, child, grandparent or sibling, any other person related to the person by consanguinity or affinity to the second degree or any other lawful representative of the person, except if the person or the person's spouse, parent, child, grandparent, sibling, other person related to the person by consanguinity or affinity to the second degree or other lawful representative is in custody for an offense or is the accused. See Arizona Laws 13-4401
  • Victim advocate: work with prosecutors and assist the victims of a crime.
  • Victim Impact Statement: A written or spoken statement by the victim or his or her representative about the physical, emotional, and financial impact of a crime on the victim. The statement is given to the court before sentencing.
  • Visual depiction: includes each visual image that is contained in an undeveloped film, videotape or photograph or data stored in any form and that is capable of conversion into a visual image. See Arizona Laws 13-3551
  • Voting security: means any security presently entitling the owner or holder of such security to vote for the election of directors of a bank, trust company, savings and loan association or controlling person, excluding, in the case of a savings and loan association, votes attributable to savings accounts. See Arizona Laws 6-141
  • wager: means one act of risking or giving something of value for the opportunity to obtain a benefit from a game or contest of chance or skill or a future contingent event but does not include bona fide business transactions that are valid under the law of contracts including contracts for the purchase or sale at a future date of securities or commodities, contracts of indemnity or guarantee, life, health or accident insurance and fantasy sports contests as defined in section 5-1201 and conducted pursuant to Title 5, Chapter 10.   • Wholesaler: means a person who in the usual course of business lawfully supplies narcotic drugs, dangerous drugs, precursor chemicals or regulated chemicals that he himself has not produced or prepared, but not to a person for the purpose of consumption by the person, whether or not the wholesaler has a permit that is issued pursuant to title 32, chapter 18. See Arizona Laws 13-3401
  • Wilfully: means , with respect to conduct or to a circumstance described by a statute defining an offense, that a person is aware or believes that the person's conduct is of that nature or that the circumstance exists. See Arizona Laws 1-215
  • Writing: includes printing. See Arizona Laws 1-215
  • Youth sports: means recreational and amateur sporting related activities and competitions organized in the district. See Arizona Laws 5-1101
