Terms Used In Arizona Laws > Title 9 > Chapter 13 > Article 4 - Local Governments
- Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
- Administration: means the community services administration in the department of economic security. See Arizona Laws 36-3001
- Adult: means a person who has attained eighteen years of age. See Arizona Laws 1-215
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affiliate: means a person that directly or indirectly, through one or more intermediaries, controls, is controlled by or is under common control with a video service provider. See Arizona Laws 9-1401
- Agent: means an adult who has the authority to make health care treatment decisions for another person, referred to as the principal, pursuant to a health care power of attorney. See Arizona Laws 36-3201
- Agreement: means any agreement or contract. See Arizona Laws 9-1401
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- boundaries: means all of the area within the corporate limits of the city or town. See Arizona Laws 9-1401
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- contiguous: means land that adjoins or touches the other property held by the same or a related organization and land divided by a public road. See Arizona Laws 36-2999.51
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the department of economic security. See Arizona Laws 36-3101
- Domestic violence: means attempting to cause or causing bodily injury to a family or household member or placing a family or household member by threat of force in fear of imminent physical harm. See Arizona Laws 36-3001
- Domestic violence service provider: means a facility whose primary purpose is to provide services to family or household members who are victims of domestic violence, including:
(a) Shelter for victims of domestic violence. See Arizona Laws 36-3001
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Family or household member: means a spouse, a former spouse, a parent, a child or another adult person related by consanguinity or affinity who is residing or has resided or has a child or children in common with the person committing the domestic violence and dependents of such persons. - Fiscal year: means the period beginning on October 1 and ending on September 30. See Arizona Laws 36-2999.51
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fund: means the domestic violence services fund. See Arizona Laws 36-3001
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Health care directive: means a document drafted in substantial compliance with this chapter, including a mental health care power of attorney, to deal with a person's future health care decisions. See Arizona Laws 36-3201
- Health care power of attorney: means a written designation of an agent to make health care decisions that meets the requirements of section 36-3221 and that comes into effect and is durable as provided in section 36-3223, subsection A. See Arizona Laws 36-3201
- Health care provider: means a natural person who is licensed under Title 32, Chapter 11, 13, 15, 17 or 25, a hospice as defined in section 36-401 that is licensed under chapter 4 of this title or an organization that is licensed under this title, that renders health care designed to prevent, diagnose or treat illness or injury and that employs persons licensed under Title 32, Chapter 11, 13, 15, 17 or 25. - Highway: means all roads, streets and alleys and other dedicated public rights-of-way that are operated and maintained by a local government. See Arizona Laws 9-1401
- including: means not limited to and is not a term of exclusion. See Arizona Laws 1-215
- Incumbent cable operator: means a cable operator or other video service provider that on December 31, 2019 is providing video service in this state pursuant to a local license. See Arizona Laws 9-1401
- Interested person: means the patient, a person listed under section 36-3231, subsection A, a health care provider directly involved in the patient's medical care or an employee of a health care provider. See Arizona Laws 36-3201
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
- License: means a franchise as defined in 47 United States Code § 522. See Arizona Laws 9-1401
- License fee: means a license fee imposed by a local government on a video service provider for using the highways to provide and for the privilege of providing video service. See Arizona Laws 9-1401
- Lien: A claim against real or personal property in satisfaction of a debt.
- Living will: means a statement written either by a person who has not written a health care power of attorney or by the principal as an attachment to a health care power of attorney and intended to guide or control the health care treatment decisions that can be made on that person's behalf. See Arizona Laws 36-3201
- Local government: means any city, including a charter city, or town. See Arizona Laws 9-1401
- Local law: means any charter, code, ordinance, resolution, regulation or other law of a local government. See Arizona Laws 9-1401
- Local license: means any license, agreement, permit or similar authorization that meets all of the following:
(a) Allows a person to construct or operate a video service network within the boundaries of a local government. See Arizona Laws 9-1401
- Medicare resident days: means resident days that are funded by the medicare program, a medicare advantage or special needs plan or the medicare hospice program. See Arizona Laws 36-2999.51
- Net patient service revenue: means gross inpatient revenues from services that are provided to nursing facility patients minus reductions from gross inpatient revenue. See Arizona Laws 36-2999.51
- Nursing facility: means a health care institution that provides inpatient beds or resident beds and nursing services to persons who need nursing services on a continuing basis but who do not require hospital care or direct daily care from a physician. See Arizona Laws 36-2999.51
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
- Physician: means a doctor of medicine licensed pursuant to title 32, chapter 13 or doctor of osteopathic medicine licensed pursuant to Title 32, Chapter 17. See Arizona Laws 36-3201
- Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
- Population: means the population according to the most recent United States decennial census. See Arizona Laws 1-215
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Principal: means a person who is the subject of a health care power of attorney. See Arizona Laws 36-3201
- Probate: Proving a will
- Process: means a citation, writ or summons issued in the course of judicial proceedings. See Arizona Laws 1-215
- Program administrator: means the program administrator of the community services administration in the department of economic security. See Arizona Laws 36-3001
- Property: includes both real and personal property. See Arizona Laws 1-215
- Reductions from gross inpatient revenue: includes bad debts, contractual adjustments, uncompensated care, administrative, courtesy and policy discounts, adjustments and other similar revenue deductions. See Arizona Laws 36-2999.51
- Resident day: means a calendar day of care provided to a nursing facility resident, including the day of admission and excluding the day of discharge. See Arizona Laws 36-2999.51
- Service area: means that part of the boundaries of a local government within which a video service provider is authorized to provide video service pursuant to a uniform video service license or a local license. See Arizona Laws 9-1401
- shelter: means a facility providing temporary residential service or facilities to family or household members who are victims of domestic violence. See Arizona Laws 36-3001
- Surrogate: means a person authorized to make health care decisions for a patient by a power of attorney, a court order or the provisions of section 36-3231. See Arizona Laws 36-3201
- Telecommunications service: means the offering of telecommunications for a fee directly to the public, or to such users as to be effectively available directly to the public, regardless of the equipment, facilities or technology used. See Arizona Laws 9-1401
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Uniform video service license: means a license that is issued by a local government in the form of a uniform video service license agreement as adopted pursuant to section 9-1411. See Arizona Laws 9-1401
- United States: includes the District of Columbia and the territories. See Arizona Laws 1-215
- Upper payment limit: means the limitation established pursuant to 42 C. See Arizona Laws 36-2999.51
- Writing: includes printing. See Arizona Laws 1-215
