  • Administration: means the community services administration in the department of economic security. See Arizona Laws 36-3001
  • Administration: means the Arizona health care cost containment system administration. See Arizona Laws 36-2901
  • Administration: means the Arizona health care cost containment system administration. See Arizona Laws 36-2931
  • Administration: means the Arizona health care cost containment system administration. See Arizona Laws 36-2971

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affiliate: means a person that directly or indirectly, through one or more intermediaries, controls, is controlled by or is under common control with a video service provider. See Arizona Laws 9-1401
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agent: means an adult who has the authority to make health care treatment decisions for another person, referred to as the principal, pursuant to a health care power of attorney. See Arizona Laws 36-3201
  • Agreement: means any agreement or contract. See Arizona Laws 9-1401
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attending physician: means a physician who has the primary responsibility for a principal's health care. See Arizona Laws 36-3201
  • Bank: means a corporation that holds a banking permit issued pursuant to chapter 2 of this title. See Arizona Laws 6-101
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • boundaries: means all of the area within the corporate limits of the city or town. See Arizona Laws 9-1401
  • Capitation rate: means a mode of payment which the program contractor receives for the delivery of services to members pursuant to this article and which is based on a fixed rate per person notwithstanding the amount of services provided to a member. See Arizona Laws 36-2931
  • Citrus: means varieties of the genus citrus that are commercially produced in this state for the fresh market or for juice production but does not include commercially produced by-products or products manufactured for resale. See Arizona Laws 3-468
  • Clerical or support duties: means duties subsequent to the receipt of a residential mortgage loan application, including both of the following:

    (a) The receipt, collection, distribution and analysis of information common for the processing or underwriting of a residential mortgage loan. See Arizona Laws 6-991

  • Commercial mobile service provider: means a person that provides commercial mobile service as defined in 47 United States Code § 332(d) or commercial mobile radio service as described in 47 C. See Arizona Laws 9-1401
  • Commercial mortgage banker: means a person who engages in the following:

    (a) Originating commercial mortgage loans. See Arizona Laws 6-971

  • Commercial mortgage loan: means a loan that is directly or indirectly secured by a mortgage or deed of trust or any lien interest on commercial property and created with the consent of the owner of the commercial property. See Arizona Laws 6-971
  • Compensation: means anything of value or any benefit including points, commissions, bonuses, referral fees, loan origination fees and other similar fees but excluding periodic interest resulting from the application of the note rate of interest to the outstanding principal balance remaining unpaid from time to time. See Arizona Laws 6-971
  • Consumer lender: means a person who is licensed pursuant to chapter 5 of this title. See Arizona Laws 6-991
  • contiguous: means land that adjoins or touches the other property held by the same or a related organization and land divided by a public road. See Arizona Laws 36-2999.51
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contractor: means a person or entity that has a prepaid capitated contract with the administration pursuant to section 36-2904 or chapter 34 of this title to provide health care to members under this article or persons under chapter 34 of this title either directly or through subcontracts with providers. See Arizona Laws 36-2901
  • Contractor: means a person or entity that has a prepaid capitated contract with the administration pursuant to section 36-2904 to provide health care to members under this article either directly or through subcontracts with providers. See Arizona Laws 36-2971
  • Contractor: means a health plan that contracts with the administration to provide hospitalization and medical care to members according to this article or a qualifying plan. See Arizona Laws 36-2981
  • Council: means the Arizona citrus research council. See Arizona Laws 3-468
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Day: means a calendar day, except a Saturday or Sunday or a holiday prescribed in section 1-301. See Arizona Laws 9-1401
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the department of insurance and financial institutions. See Arizona Laws 6-101
  • Department: means the department of economic security. See Arizona Laws 36-3101
  • Department: means the department of economic security. See Arizona Laws 36-2901
  • Department: means the department of economic security. See Arizona Laws 36-2931
  • Department: means the department of economic security. See Arizona Laws 36-2971
  • Dependent: A person dependent for support upon another.
  • Deputy director: means the deputy director of the financial institutions division of the department. See Arizona Laws 6-101
  • Director: means the director of the Arizona health care cost containment system administration. See Arizona Laws 36-2901
  • Director: means the director of the Arizona health care cost containment system administration. See Arizona Laws 36-2931
  • Director: means the director of the Arizona health care cost containment system administration. See Arizona Laws 36-2971
  • Director: means the director of the administration. See Arizona Laws 36-2981
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Division: means the financial institutions division within the department. See Arizona Laws 6-101
  • Domestic violence: means attempting to cause or causing bodily injury to a family or household member or placing a family or household member by threat of force in fear of imminent physical harm. See Arizona Laws 36-3001
  • Domestic violence service provider: means a facility whose primary purpose is to provide services to family or household members who are victims of domestic violence, including:

    (a) Shelter for victims of domestic violence. See Arizona Laws 36-3001

  • Donor: The person who makes a gift.
  • Eligible person: means any person who is:

    (a) Any of the following:

    (i) Defined as mandatorily or optionally eligible pursuant to title XIX of the social security act as authorized by the state plan. See Arizona Laws 36-2901

  • Eligible person: means a person who:

    (a) Is a resident of this state and a United States citizen or a person who meets the requirements for qualified alien status as determined pursuant to Section 36-2903. See Arizona Laws 36-2931

  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Enterprise: means any person under the jurisdiction of the department other than a financial institution. See Arizona Laws 6-101
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Ex officio: Literally, by virtue of one's office.
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Family or household member: means a spouse, a former spouse, a parent, a child or another adult person related by consanguinity or affinity who is residing or has resided or has a child or children in common with the person committing the domestic violence and dependents of such persons. See Arizona Laws 36-3001
  • Federal banking agency: means the board of governors of the federal reserve system, the comptroller of the currency, the director of the office of thrift supervision, the national credit union administration or the federal deposit insurance corporation. See Arizona Laws 6-991
  • Federal poverty guidelines: means the poverty guidelines as updated annually in the federal register by the United States department of health and human services. See Arizona Laws 1-215
  • Federal poverty level: means the federal poverty level guidelines published annually by the United States department of health and human services. See Arizona Laws 36-2981
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
  • Fiduciary: A trustee, executor, or administrator.
  • Financial institution: means banks, trust companies, savings and loan associations, credit unions, consumer lenders, international banking facilities and financial institution holding companies under the jurisdiction of the department. See Arizona Laws 6-101
  • Fiscal year: means the period beginning on October 1 and ending on September 30. See Arizona Laws 36-2999.51
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • Fund: means the domestic violence services fund. See Arizona Laws 36-3001
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Generally accepted accounting principles: means United States generally accepted accounting principles issued by the financial accounting standards board or the international financial reporting standards issued by the international accounting standards board. See Arizona Laws 6-971
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Graduate medical education: means a program, including an approved fellowship, that prepares a physician for the independent practice of medicine by providing didactic and clinical education in a medical discipline to a medical student who has completed a recognized undergraduate medical education program. See Arizona Laws 36-2901
  • Grantee: includes every person to whom an estate or interest in real property passes, in or by a deed. See Arizona Laws 1-215
  • Grower-shipper: means a person who is engaged in this state in the business of packing, shipping, transporting or selling citrus of which the person is a grower, producer or owner. See Arizona Laws 3-468
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Handler: means a person who engages in marketing citrus on behalf of a grower, whether as a grower-shipper, owner, agent, employee, broker, dealer, consignor or commission merchant or otherwise. See Arizona Laws 3-468
  • Health care directive: means a document drafted in substantial compliance with this chapter, including a mental health care power of attorney, to deal with a person's future health care decisions. See Arizona Laws 36-3201
  • Health care power of attorney: means a written designation of an agent to make health care decisions that meets the requirements of section 36-3221 and that comes into effect and is durable as provided in section 36-3223, subsection A. See Arizona Laws 36-3201
  • Health care provider: means a natural person who is licensed under Title 32, Chapter 11, 13, 15, 17 or 25, a hospice as defined in section 36-401 that is licensed under chapter 4 of this title or an organization that is licensed under this title, that renders health care designed to prevent, diagnose or treat illness or injury and that employs persons licensed under Title 32, Chapter 11, 13, 15, 17 or 25.   • Health plan: means an entity that contracts with the administration for services provided pursuant to article 1 of this chapter. See Arizona Laws 36-2981
  • Highway: means all roads, streets and alleys and other dedicated public rights-of-way that are operated and maintained by a local government. See Arizona Laws 9-1401
  • Holder: means a video service provider that has been issued a uniform video service license pursuant to this chapter. See Arizona Laws 9-1401
  • Holdover cable operator: means an incumbent cable operator that elects under sections 9-1412 and 9-1413 to continue to operate within its service area pursuant to its local license. See Arizona Laws 9-1401
  • Home and community based services: means services described in section 36-2939, subsection B, paragraph 2 and subsection C. See Arizona Laws 36-2931
  • Immediate family member: means a spouse, child, sibling, parent, grandparent, grandchild, stepparent, stepchild or stepsibling whether related by adoption or blood. See Arizona Laws 6-991
  • Incumbent cable operator: means a cable operator or other video service provider that on December 31, 2019 is providing video service in this state pursuant to a local license. See Arizona Laws 9-1401
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Inpatient psychiatric facility: means a hospital that contains an organized psychiatric services unit or a special hospital that is licensed to provide psychiatric services. See Arizona Laws 36-3201
  • Institutional services: means services described in section 36-2939, subsection A, paragraph 1 and subsection B, paragraph 1. See Arizona Laws 36-2931
  • Interested person: means the patient, a person listed under section 36-3231, subsection A, a health care provider directly involved in the patient's medical care or an employee of a health care provider. See Arizona Laws 36-3201
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Judgment: means either:

    (a) A final judgment in a court of competent jurisdiction. See Arizona Laws 6-991

  • Judgment debtor: means any defendant under this article who is the subject of a judgment. See Arizona Laws 6-991
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legal tender: coins, dollar bills, or other currency issued by a government as official money. Source: U.S. Mint
  • Lessee: means a person contracting with a lessor for the use of a safe deposit repository. See Arizona Laws 6-1001
  • Lessor: means a corporation or association authorized under the laws of this state, any other state or the United States to do business as a bank, trust company, credit union or savings and loan association and maintaining safe deposit repositories for public use. See Arizona Laws 6-1001
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a franchise as defined in 47 United States Code § 522. See Arizona Laws 9-1401
  • License: means a license issued under this article. See Arizona Laws 6-991
  • License fee: means a license fee imposed by a local government on a video service provider for using the highways to provide and for the privilege of providing video service. See Arizona Laws 9-1401
  • Licensee: means a person who is licensed under this article. See Arizona Laws 6-971
  • Licensee: means a person licensed under this article. See Arizona Laws 6-991
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Living will: means a statement written either by a person who has not written a health care power of attorney or by the principal as an attachment to a health care power of attorney and intended to guide or control the health care treatment decisions that can be made on that person's behalf. See Arizona Laws 36-3201
  • Loan processor or underwriter: means an individual who performs clerical or support duties as an employee at the direction of and subject to the supervision and instruction of a person who is licensed or who is exempt from licensure under article 1 or 2 of this chapter. See Arizona Laws 6-991
  • Local government: means any city, including a charter city, or town. See Arizona Laws 9-1401
  • Local law: means any charter, code, ordinance, resolution, regulation or other law of a local government. See Arizona Laws 9-1401
  • Local license: means any license, agreement, permit or similar authorization that meets all of the following:

    (a) Allows a person to construct or operate a video service network within the boundaries of a local government. See Arizona Laws 9-1401

  • Malice: means evil intent and outrageous, oppressive or intolerable conduct that creates a substantial risk of tremendous harm to others. See Arizona Laws 36-2901
  • Medicare resident days: means resident days that are funded by the medicare program, a medicare advantage or special needs plan or the medicare hospice program. See Arizona Laws 36-2999.51
  • Member: means an eligible person who enrolls in the system. See Arizona Laws 36-2901
  • Member: means an eligible person who is enrolled in the system. See Arizona Laws 36-2931
  • Member: means an eligible person who enrolls in the system and who is defined as a qualified medicare beneficiary pursuant to section 1905(p) of title XIX of the social security act and whose income does not exceed one hundred per cent of the federal poverty guidelines. See Arizona Laws 36-2971
  • Member: means a person who is eligible for and enrolled in the program, who is under nineteen years of age and whose gross household income meets the following requirements:

    (a) Beginning on October 1, 1999 through September 30, 2023, has income at or below two hundred percent of the federal poverty level. See Arizona Laws 36-2981

  • Minor: means a person under eighteen years of age. See Arizona Laws 1-215
  • Month: means a calendar month unless otherwise expressed. See Arizona Laws 1-215
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage banker: means a person who is licensed pursuant to article 2 of this chapter. See Arizona Laws 6-991
  • Mortgage broker: means a person who is licensed pursuant to article 1 of this chapter. See Arizona Laws 6-991
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Net patient service revenue: means gross inpatient revenues from services that are provided to nursing facility patients minus reductions from gross inpatient revenue. See Arizona Laws 36-2999.51
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Noncontracting provider: means a person who provides health care to members pursuant to this article but not pursuant to a subcontract with a contractor. See Arizona Laws 36-2901
  • Noncontracting provider: means a person who provides services as prescribed by section 36-2939 and who does not have a subcontract with a program contractor. See Arizona Laws 36-2931
  • Noncontracting provider: means an entity that provides hospital or medical care but does not have a contract or subcontract with the administration. See Arizona Laws 36-2981
  • Nursing facility: means a health care institution that provides inpatient beds or resident beds and nursing services to persons who need nursing services on a continuing basis but who do not require hospital care or direct daily care from a physician. See Arizona Laws 36-2999.51
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Physician: means a doctor of medicine licensed pursuant to title 32, chapter 13 or doctor of osteopathic medicine licensed pursuant to Title 32, Chapter 17. See Arizona Laws 36-3201
  • Physician: means a person who is licensed pursuant to Title 32, Chapter 13 or 17. See Arizona Laws 36-2901
  • Physician: means a person who is licensed pursuant to Title 32, Chapter 13 or 17. See Arizona Laws 36-2981
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Population: means the population according to the most recent United States decennial census. See Arizona Laws 1-215
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Prepaid capitated: means a mode of payment by which a health care contractor directly delivers health care services for the duration of a contract to a maximum specified number of members based on a fixed rate per member notwithstanding:

    (a) The actual number of members who receive care from the contractor. See Arizona Laws 36-2901

  • Primary care physician: means a physician who is a family practitioner, general practitioner, pediatrician, general internist, or obstetrician or gynecologist. See Arizona Laws 36-2901
  • Primary care physician: means a physician who is a family practitioner, general practitioner, pediatrician, general internist, or obstetrician or gynecologist. See Arizona Laws 36-2971
  • Primary care physician: means a physician who is a family practitioner, general practitioner, pediatrician, general internist, obstetrician or gynecologist. See Arizona Laws 36-2981
  • Primary care practitioner: means a nurse practitioner or certified nurse midwife who is certified pursuant to Title 32, Chapter 15 or a physician assistant who is licensed pursuant to Title 32, Chapter 25. See Arizona Laws 36-2901
  • Primary care practitioner: means a nurse practitioner certified pursuant to Title 32, Chapter 15 or a physician assistant certified pursuant to Title 32, Chapter 25. See Arizona Laws 36-2971
  • Primary care practitioner: means a nurse practitioner who is certified pursuant to Title 32, Chapter 15 or a physician assistant who is licensed pursuant to Title 32, Chapter 25 and who is acting within the respective scope of practice of those chapters. See Arizona Laws 36-2981
  • Principal: means a person who is the subject of a health care power of attorney. See Arizona Laws 36-3201
  • Probate: Proving a will
  • Producer: means a person who is engaged in this state in the business of commercially producing or causing citrus to be commercially produced. See Arizona Laws 3-468
  • Program: means the children's health insurance program. See Arizona Laws 36-2981
  • Program administrator: means the program administrator of the community services administration in the department of economic security. See Arizona Laws 36-3001
  • Program contractor: means the department or any other entity that contracts with the administration pursuant to section 36-2940 or 36-2944 to provide services to members pursuant to this article. See Arizona Laws 36-2931
  • Program contractor: means the department or any other entity that contracts with the administration pursuant to section 36-2940 or 36-2944. See Arizona Laws 36-2971
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Provider: means a person who subcontracts with a program contractor for the delivery of services to members pursuant to this article. See Arizona Laws 36-2931
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Qualified medicare beneficiary only: means an eligible person who is determined eligible pursuant to this article and who is not enrolled as a member under either article 1 or 2 of this chapter. See Arizona Laws 36-2971
  • Qualifying plan: means a contractor that contracts with the state pursuant to section 38-651 to provide health and accident insurance for state employees and that provides services to members pursuant to section 36-2989, subsection A. See Arizona Laws 36-2981
  • Quorum: The number of legislators that must be present to do business.
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset.   • Reductions from gross inpatient revenue: includes bad debts, contractual adjustments, uncompensated care, administrative, courtesy and policy discounts, adjustments and other similar revenue deductions. See Arizona Laws 36-2999.51
  • Registered loan originator: means any individual who is both of the following:

    (a) A loan originator who is registered with and maintains a unique identifier through the nationwide mortgage licensing system and registry established by the secure and fair enforcement for mortgage licensing act of 2008 (P. See Arizona Laws 6-991

  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • repository: means a safe deposit box or any other safe deposit receptacle and includes the lessor's vault space made available for use by the lessee in common with others for the storage of property or documents. See Arizona Laws 6-1001
  • Resident day: means a calendar day of care provided to a nursing facility resident, including the day of admission and excluding the day of discharge. See Arizona Laws 36-2999.51
  • residential mortgage loan: means a loan for personal family or household use that is secured by a mortgage, deed of trust or other equivalent consensual security interest on a dwelling, as defined in the truth in lending act (15 United States Code § 1602(v)), or residential real estate on which a dwelling is constructed or intended to be constructed.   • Residential mortgage loan servicer: means any person who does either of the following:

    (a) On behalf of the noteholder, collects or receives payments, including payments of principal, interest, escrow monies and other monies due, on obligations due and owing to the noteholder pursuant to a residential mortgage loan. See Arizona Laws 6-991

  • Residential real estate: means any property that is located in this state and on which a dwelling is constructed or intended to be constructed. See Arizona Laws 6-991
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Service area: means that part of the boundaries of a local government within which a video service provider is authorized to provide video service pursuant to a uniform video service license or a local license. See Arizona Laws 9-1401
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • shelter: means a facility providing temporary residential service or facilities to family or household members who are victims of domestic violence. See Arizona Laws 36-3001
  • Special health care district: means a special health care district organized pursuant to Title 48, Chapter 31. See Arizona Laws 36-2901

  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Surrogate: means a person authorized to make health care decisions for a patient by a power of attorney, a court order or the provisions of section 36-3231. See Arizona Laws 36-3201
  • System: means the Arizona health care cost containment system established by this article. See Arizona Laws 36-2901
  • System: means the Arizona long-term care system. See Arizona Laws 36-2931
  • System: means the Arizona health care cost containment system established by article 1 of this chapter and the Arizona long-term care system established by article 2 of this chapter. See Arizona Laws 36-2971
  • Telecommunications provider: means a person that is required to obtain from the corporation commission a certificate of public convenience and necessity to provide telecommunications service. See Arizona Laws 9-1401
  • Telecommunications service: means the offering of telecommunications for a fee directly to the public, or to such users as to be effectively available directly to the public, regardless of the equipment, facilities or technology used. See Arizona Laws 9-1401
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Tribal facility: means a facility that is operated by an Indian tribe and that is authorized to provide services pursuant to Public Law 93-638, as amended. See Arizona Laws 36-2981
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC

  • Upper payment limit: means the limitation established pursuant to 42 C. See Arizona Laws 36-2999.51
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
