No utility shall be held liable for the acts or omissions of any person in implementing or attempting to implement those measures found cost-effective by, or recommended as a result of, an energy audit. The findings and recommendations of an energy audit shall not be construed to be a warranty or guarantee of any kind, nor shall such findings or recommendations subject the utility to liability of any kind. Nothing in ss. 366.80366.83 and 403.519 shall preempt or affect litigation pending on June 5, 1980, nor shall ss. 366.80366.83 and 403.519 preempt federal law unless such preemption is expressly authorized by federal statute.
