§ 806. Exclusion. a. A person who was not a member of a public retirement system as of March thirty-first, nineteen hundred ninety-three shall be ineligible for the benefits provided by sections eight hundred one and eight hundred three of this article.

- Public retirement system: shall mean the New York state and local employees' retirement system, the New York state and local police and fire retirement system, New York state teachers' retirement system, New York city employees' retirement system, New York city teachers' retirement system, New York city police pension fund, New York city fire department pension fund and the New York city board of education retirement system. b. This article shall have no application to a retiree or former retiree from a public retirement system.
