(1) No unauthorized insurer shall institute or file, or cause to be instituted or filed, any suit, action or proceeding in this state to enforce any right, claim or demand arising out of any insurance transaction in this state.
(2) This section does not apply as to:
(a) Transactions permitted under section 41-306[, Idaho Code,] (exceptions to certificate of authority requirement).
(b) Coverages exempted from the surplus line law under section 41-1212[, Idaho Code].

- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Service of process: The service of writs or summonses to the appropriate party.
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
