- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
The Secretary’s order shall be based on the recommendations contained in the hearing officer’s report unless the Secretary disagrees in any regard with the report of the hearing officer, in which case the Secretary may issue an order in contravention of the report. The hearing officer’s report and Secretary’s order are not admissible in evidence against the person in a criminal prosecution brought for a violation of this Act, but the hearing, report, and order are not a bar to a criminal prosecution brought for the violation of this Act.
