Sec. 26.1. (a) As used in this section, “armed forces” means the active and reserve components of the following:

(1) The United States Army.

Terms Used In Indiana Code 27-1-22-26.1

  • armed forces: means the following:

    Indiana Code 27-1-22-26

  • Commissioner: means the "insurance commissioner" of this state. See Indiana Code 27-1-2-3
  • Insurance: means a contract of insurance or an agreement by which one (1) party, for a consideration, promises to pay money or its equivalent or to do an act valuable to the insured upon the destruction, loss or injury of something in which the other party has a pecuniary interest, or in consideration of a price paid, adequate to the risk, becomes security to the other against loss by certain specified risks; to grant indemnity or security against loss for a consideration. See Indiana Code 27-1-2-3
  • insurer: means a company, firm, partnership, association, order, society or system making any kind or kinds of insurance and shall include associations operating as Lloyds, reciprocal or inter-insurers, or individual underwriters. See Indiana Code 27-1-2-3
  • motor vehicle insurance: means any type of insurance described in IC 27-1-5-1, Class 2(f). See Indiana Code 27-1-22-26
  • premium: means money or any other thing of value paid or given in consideration to an insurer, insurance producer, or solicitor on account of or in connection with a contract of insurance and shall include as a part but not in limitation of the above, policy fees, admission fees, membership fees and regular or special assessments and payments made on account of annuities. See Indiana Code 27-1-2-3
  • rating plan: means the rating schedule or rating plan of an insurer concerning premium rates for motor vehicle insurance that has been filed with the commissioner and is in effect under section 4 of this chapter. See Indiana Code 27-1-22-26
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
(2) The United States Navy.

(3) The United States Air Force.

(4) The United States Marine Corps.

(5) The United States Coast Guard.

(6) The Indiana National Guard.

     (b) As used in this section, “motor vehicle insurance” means any type of insurance described in IC 27-1-5-1, Class 2(f).

     (c) As used in this chapter, “rating plan” means the rating schedule or rating plan of an insurer:

(1) concerning premium rates for motor vehicle insurance;

(2) that has been filed with the commissioner; and

(3) that is in effect under section 4 of this chapter.

     (d) An insurer that issues or renews a policy of motor vehicle insurance may not set the premium rate for a policy of motor vehicle insurance that covers an individual who is serving in one (1) of the armed forces at an amount higher than the applicable rate set forth in the rating plan for a policy of motor vehicle insurance that covers an individual who is not serving in one (1) of the armed forces.

     (e) A violation of this section is an unfair and deceptive act or practice in the business of insurance under IC 27-4-1-4.
