Terms Used In Indiana Code > Title 27 > Article 1 - Department of Insurance
- accident and sickness insurance: means insurance described in Class 1(b), Class 1(c)(2), or Class 2(a) of IC 27-1-5-1. See Indiana Code 27-1-12.8-1
- accredited state: means a state in which the insurance department or regulatory agency has qualified as meeting the minimum financial regulatory standards promulgated and established by the NAIC. See Indiana Code 27-1-35-2
- actuary: means a person who is a member in good standing of the American Academy of Actuaries. See Indiana Code 27-1-33-1
- adjusted RBC report: means an RBC report that has been adjusted by the commissioner under section 28 of this chapter. See Indiana Code 27-1-36-2
- Administrator: means a person who directly or indirectly and on behalf of an insurer underwrites, collects charges or premiums from, or adjusts or settles claims on residents of Indiana in connection with life, annuity, or health coverage offered or provided by an insurer. See Indiana Code 27-1-25-1
- administrator: means the entity that contracts with the department to create, operate, and maintain the data base. See Indiana Code 27-1-44.5-0.2
- administrator: has the meaning in Indiana Code 27-1-44.6-1
- adverse determination: means a denial of a request for benefits on the grounds that the health service or item:

- advisory board: means the all payer claims data base advisory board established under Indiana Code 27-1-44.5-0.4
- advisory board: refers to the all payer claims data base advisory board established under section 5 of this chapter. See Indiana Code 27-1-44.6-2
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- affiliate: means a domestic life insurance company that is a wholly owned subsidiary of the parent of a limited purpose subsidiary. See Indiana Code 27-1-12.1-1
- affiliate: means any person who, directly or indirectly through one (1) or more intermediaries, controls, is controlled by, or is under common control with, the person to whom affiliation is attributed. See Indiana Code 27-1-37-0.2
- affiliate: has the meaning set forth in IC 27-1-25-1. See Indiana Code 27-1-37.3-2
- affiliate: means a company that controls, is controlled by, or is under common control with another company. See Indiana Code 27-1-38-1
- affiliated group: means a group of affiliates. See Indiana Code 27-1-15.8-1
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- Agency billed: refers to a system in which an insured pays a premium directly to an insurance agency. See Indiana Code 27-1-2-3
- Allegation: something that someone says happened.
- ambulance service provider: means a person that:

- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Amortization: Paying off a loan by regular installments.
- ancillary protection product: includes the following:

- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.

- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- appointed actuary: means a qualified actuary who is appointed to prepare an actuarial opinion required by sections 21 and 22 of this chapter. See Indiana Code 27-1-12.8-2

- arrangement: refers to a multiple employer welfare arrangement. See Indiana Code 27-1-34-1
- articles of incorporation: includes both the original articles of incorporation and any and all amendments thereto, except where the original articles of incorporation only are expressly referred to, and includes articles of merger, consolidation and reinsurance, and in case of corporations, heretofore organized, articles of reorganization filed in the office of the secretary of state, and all amendments thereto. - Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
- audit committee: means a body established by the board of directors of a domestic insurer or group of insurers for the purpose of overseeing:

- authorized control level event: has the meaning set forth in section 39 of this chapter. See Indiana Code 27-1-36-3
- authorized control level RBC: means , with respect to an insurer, the number determined under the risk-based capital formula in accordance with the RBC Instructions. See Indiana Code 27-1-36-4
- automated claims adjudication system: means a preprogrammed computer system that:

- bad-faith filing: as used in this chapter , means a rate filing made by any filer who, in bad faith, files a rate which it knows, or should know, is grossly inadequate for the insurance coverage provided, and which is filed and used for the purpose of unfairly obtaining a particular risk or limited group of risks, and which is available only to such risk or limited group of risks. See Indiana Code 27-1-22-6
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Bequest: Property gifted by will.
- capital: means the aggregate amount paid in on the shares of capital stock of a corporation issued and outstanding. See Indiana Code 27-1-2-3
- capital stock: means the aggregate amount of the par value of all shares of capital stock. See Indiana Code 27-1-2-3
- capitated rate reimbursement arrangement: means a fixed amount of money per patient per unit of time paid in advance to the health care provider for the delivery of health care services. See Indiana Code 27-1-37.6-2
- casualty and liability insurance: means the types of insurance described in IC 27-1-5-1, Class 2(h) and 2(l). See Indiana Code 27-1-30-2
- casualty insurance company: has the meaning set forth in IC 27-1-2-3(t). See Indiana Code 27-1-30-3
- casualty insurance company: means any company making the kind or kinds of insurance set out and defined in class 2 of IC 27-1-5-1. See Indiana Code 27-1-2-3
- catastrophe: means an event that is the subject of a declaration by the commissioner and that:

- certificate: means a document issued to an individual group member as evidence of the group member's coverage under a master group insurance policy. See Indiana Code 27-1-41-1
- certificate of authority: means an instrument in writing issued by the department to an insurer, which sets out the authority of such insurer to engage in the business of insurance or activities connected therewith. See Indiana Code 27-1-2-3
- certificate of insurance: means a document prepared by an insurer or insurance producer as evidence of property or casualty insurance coverage. See Indiana Code 27-1-42-2
- CGAD: means a confidential report filed by an insurer or insurance group under this chapter. See Indiana Code 27-1-4.1-2
- change in fund basis: refers to a valuation basis under which the interest rate used to determine the minimum valuation standard applicable to each change in the fund held under an annuity or a guaranteed interest contract is the calendar year valuation interest rate for the year of the change in the fund. See Indiana Code 27-1-12.8-3
- Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
- Church plan: has the meaning set forth in IC 27-8-10-1. See Indiana Code 27-1-25-1
- clean claim: means a claim for payment for ambulance service:

- Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
- clinical peer: means a practitioner or other health care provider who either:

- commercial policyholder: means a business, nonprofit, or governmental entity that purchases a policy of commercial insurance through an insurance producer licensed under Indiana Code 27-1-22-2.5
- commission: refers to the Indiana political subdivision risk management commission established by this chapter. See Indiana Code 27-1-29-1
- commission: refers to the Indiana political subdivision risk management commission established by IC 27-1-29-5. See Indiana Code 27-1-29.1-1
- commissioner: refers to the insurance commissioner appointed under IC 27-1-1-2. See Indiana Code 27-1-3.1-1

- company: means any person engaging in or proposing or attempting to engage in any transaction or kind of insurance or surety business and any person or group of persons who may otherwise be subject to the administrative, regulatory, or taxing authority of the commissioner. - company action level event: has the meaning set forth in section 29 of this chapter. See Indiana Code 27-1-36-5
- company action level RBC: means , with respect to an insurer, the product of two (2) multiplied by the insurer's authorized control level RBC. See Indiana Code 27-1-36-6
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- consortium: refers to a self-insurance consortium established under section 7 of this chapter. See Indiana Code 27-1-39-2
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- contract: means a contract or a policy. See Indiana Code 27-1-12.8-6
- contract holder: means :

- contractholder behavior: means an action taken by a contract holder, certificate holder, or another person possessing the right to elect options, including:

- controlled insurer: means a licensed insurer that is controlled, directly or indirectly, by a producer. See Indiana Code 27-1-35-5
- controlling producer: means a producer that, directly or indirectly, controls an insurer. See Indiana Code 27-1-35-6
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- corporation: as used in this chapter and IC 27-1-8, means any company organized or reorganized under the provisions of this article and any company organized or reorganized under the provisions of any statute of this state enacted prior to March 8, 1935. See Indiana Code 27-1-7-1
- corporation: has the meaning set forth in IC 27-1-2-3. See Indiana Code 27-1-7.5-1
- corporation: means an insurance company and includes all persons, partnerships, corporations, associations, orders or societies engaged in or proposing to engage in making any kind of insurance authorized by the laws of this state. See Indiana Code 27-1-2-3
- corrective order: means an order issued by the commissioner that specifies the corrective actions that the commissioner determines are required. See Indiana Code 27-1-36-7
- covered individual: means an individual who is entitled to coverage under a health plan. See Indiana Code 27-1-2.3-3
- covered individual: means an individual who is entitled to coverage under a health plan. See Indiana Code 27-1-24.5-1
- Covered individual: means an individual who is covered under a benefit program provided by an insurer. See Indiana Code 27-1-25-1
- covered individual: means an individual who is entitled to coverage under a health plan. See Indiana Code 27-1-37.3-4
- covered individual: means an individual who is entitled to coverage under a health plan. See Indiana Code 27-1-37.4-1
- covered individual: means an individual who is covered under a health plan. See Indiana Code 27-1-37.5-2
- covered individual: means an individual who is entitled to be provided health care services at a cost established according to a network plan. See Indiana Code 27-1-45-1

- CPT code: refers to the medical billing code that applies to a specific health care service, as published in the Current Procedural Terminology code set maintained by the American Medical Association. See Indiana Code 27-1-48-2
- customer: means a person who purchases portable electronics. See Indiana Code 27-1-15.9-2
- customer: means a person that obtains the use of storage space from a self-storage facility under the terms of a self-storage rental agreement. See Indiana Code 27-1-16.1-2
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- data base: refers to the all payer claims data base created under this chapter. See Indiana Code 27-1-44.5-1
- data base: refers to the all payer claims data base established under Indiana Code 27-1-44.6-3
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- defined cost sharing: means a deductible payment or coinsurance amount imposed on a covered individual for a covered prescription drug under the covered individual's health insurance coverage. See Indiana Code 27-1-49-2
- defined cost sharing: means a deductible payment or coinsurance amount imposed on a covered individual for a covered prescription drug under the covered individual's health insurance coverage. See Indiana Code 27-1-50-2
- department: refers to the department of insurance of Indiana. See Indiana Code 27-1-3.1-3

- director: means an individual who is or was a director of a corporation or an individual who, while a director of a corporation, is or was serving at the corporation's request as a director, officer, partner, trustee, employee, or agent of another foreign or domestic corporation, partnership, joint venture, trust, employee benefit plan, or other enterprise, whether for profit or not. - Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- domestic corporation: means an insurance company organized under the insurance laws of this state. See Indiana Code 27-1-2-3

- Enterprise risk: means an activity, circumstance, event, or series of events that involves at least one (1) affiliate of an insurer that, if not remedied promptly, is likely to have a material adverse effect upon the financial condition or liquidity of the insurer or the insurer's insurance holding company system as a whole, including an activity, circumstance, event, or series of events that would cause the:

- episode of care: means the medical care ordered to be provided for a specific medical procedure, condition, or illness. See Indiana Code 27-1-46-1.5
- equal access and incentives: means that a pharmacy benefit manager allows any willing pharmacy provider to participate as part of any of the pharmacy benefit manager's networks as long as the pharmacy provider agrees to the terms and conditions of the relevant contract applicable to any other pharmacy provider within that network. - Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. - Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
- Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
- Fiduciary: A trustee, executor, or administrator.
- Financial institution: means a bank, savings association, credit union, or any other institution regulated under IC 28 or federal law. See Indiana Code 27-1-25-1
- fire and marine insurance company: means any company making the kind or kinds of insurance set out and defined in class 3 of IC 27-1-5-1. See Indiana Code 27-1-2-3
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- fixed fee schedule: means a total listing of fees used by a health plan to reimburse health care providers or facilities whether:

- Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
- You are late making a payment or commit some other default, triggering an increase to a penalty rate
- The bank changes the terms of your account and you do not reject the change.
- The rate expires (if the rate was fixed for only a certain period of time).
- foreign corporation: means an insurance company organized under the laws of any state of the United States other than this state or under the laws of any territory or insular possession of the United States or the District of Columbia. See Indiana Code 27-1-2-3

- fund: refers to the political subdivision risk management fund established by this chapter. See Indiana Code 27-1-29-2

- funding agreement: means an agreement that:
