Sec. 4. (a) Subject to subsection (b), the plan sponsor of a health benefit plan may, on behalf of all covered individuals of the health benefit plan, provide consent:

(1) to the mailing to covered individuals by electronic means otherwise required by IC 27-1-43-3 of all communications related to the health benefit plan; and

Terms Used In Indiana Code 27-8-4.9-4

  • covered individual: means an individual entitled to coverage under a health benefit plan. See Indiana Code 27-8-4.9-1
  • health benefit plan: means a policy, contract, certificate, or agreement that is entered into, offered by, or issued by an insurer to provide, deliver, arrange for, pay for, or reimburse any of the costs of health care services. See Indiana Code 27-8-4.9-2
  • plan sponsor: means a person that establishes, adopts, or maintains a health benefit plan that covers individuals in Indiana. See Indiana Code 27-8-4.9-3
(2) to the electronic delivery to a covered individual of any health insurance identification card.

     (b) Before providing consent on behalf of a covered individual under subsection (a), the plan sponsor of a health benefit plan must confirm that the covered individual routinely uses electronic communications during the normal course of the covered individual’s employment.
