Sec. 13.5. (a) The budget director may determine on or after July 1 of each fiscal year the costs of operating, during the preceding fiscal year, the office of the state comptroller, the office of attorney general, the office of the treasurer of state, the department of administration, the budget agency and any other state agency that the budget director determines is attributable to the operations of other state agencies. The budget director shall establish a formula to determine those costs.

Terms Used In Indiana Code 4-12-1-13.5

  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • budget director: means the person who is director of the budget agency. See Indiana Code 4-12-1-2
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
     (b) When the budget director has determined the total attributable amount of those costs for each of the state agencies, the budget director shall certify those amounts to the state comptroller and shall transmit a duplicate of the certification to the treasurer of state.

     (c) The amount certified by the budget director for an agency supported by any dedicated fund is appropriated to pay that cost from the dedicated fund used to support that agency. On receipt of the certification of the budget director, the state comptroller shall transfer from the dedicated funds to the state general fund the amounts certified by the budget director. The state comptroller shall make the appropriate entries in the records of those dedicated funds. The treasurer of state shall make the appropriate entries in the treasurer of state’s records.
