- absolute preference: means a requirement that a governmental body must purchase supplies described under this chapter, regardless of price. See Indiana Code 5-22-15-2
- account: refers to the Indiana housing first account established by section 7 of this chapter. See Indiana Code 5-20-9-1
- active business operations: means all business operations that are not inactive business operations. See Indiana Code 5-10.2-9-1

- Ad valorem property tax levy for an ensuing calendar year: means the total property taxes imposed by a civil taxing unit for current property taxes collectible in that ensuing calendar year. See Indiana Code 6-1.1-18.5-1
- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- adjusted offer: means the offer price of an offeror for preferred supplies as determined under section 10 of this chapter. See Indiana Code 5-22-15-3
- advanced materials: means materials with engineered properties created through the development of specialized processing and synthesis technology, including ceramics, high value added metals, electronic materials, composites, polymers, and biomaterials. See Indiana Code 5-28-15-1
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affiliate: means a parent, descendant, spouse, spouse of a descendant, brother, sister, spouse of a brother or sister, employee, director, officer, partner, limited liability company manager or member, joint venturer, a corporation subject to common control with the architect, engineer or construction manager, a shareholder or corporation who controls the architect, engineer or construction manager, or a corporation controlled by the architect, engineer, or construction manager. - affiliated group: means any combination of the following:

- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- agency: refers to the following:

- agency: means the agency or other entity that administers the affordable housing program under this chapter. See Indiana Code 5-20-5-1
- Agent: shall include any board, commission, trustee, officer or agent which acts on behalf of a state agency. See Indiana Code 5-16-5.5-1
- agreement: means an agreement between a lender and the corporation under which a lender may participate in the program. See Indiana Code 5-28-29-1
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Amortization: Paying off a loan by regular installments.
- Annual percentage rate: The cost of credit at a yearly rate. It is calculated in a standard way, taking the average compound interest rate over the term of the loan so borrowers can compare loans. Lenders are required by law to disclose a card account's APR. Source: FDIC
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- applicable public works statute: refers to whichever of the following statutes is applicable to public works projects of the public agency:

- Appraisal: A determination of property value.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Architect: means the person registered under IC 25-4-1. See Indiana Code 5-16-10-1
- Arrest: Taking physical custody of a person by lawful authority.
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
- audit committee: refers to the audit and financial reporting subcommittee of the legislative council established by Indiana Code 5-11-1-16
- audited entity: has the meaning set forth in Indiana Code 5-11-1-16
- Authority: means the Indiana housing and community development authority created by section 3 of this chapter. See Indiana Code 5-20-1-2
- Authority: refers to the Indiana housing and community development authority created by IC 5-20-1-3. See Indiana Code 5-20-2-2
- authority: refers to the Indiana housing and community development authority established under IC 5-20-1. See Indiana Code 5-20-4-3
- authority: means the Indiana housing and community development authority created by IC 5-20-1-3. See Indiana Code 5-20-5-2

- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.

- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Bequest: Property gifted by will.
- biotechnology: means the continually expanding body of fundamental knowledge about the functioning of biological systems from the macro level to the molecular and subatomic levels, as well as novel products, services, technologies, and subtechnologies developed as a result of insights gained from research advances that add to that body of fundamental knowledge. - board: refers to the board of elections and registration established by section 3 of this chapter. See Indiana Code 3-6-5.2-2

- bridge company: means a company which owns or operates a toll bridge or an approach or facility operated in connection with such a bridge. See Indiana Code 6-1.1-8-2
- broadband services: includes services, including voice, video, and data, that provide capacity for transmission of more than three hundred eighty-four (384) kilobits per second in at least one (1) direction regardless of the technology or medium used, including wireless, copper wire, fiber optic cable, or coaxial cable. - bureau: refers to the rehabilitation services bureau of the division of disability and rehabilitative services established under IC 12-12-1-1. See Indiana Code 5-22-12-2
- bus company: means a company (other than a street railway company) which is principally engaged in the business of transporting persons for hire by bus in or through two (2) or more townships of this state. See Indiana Code 6-1.1-8-2
- business: means any of the following that exist for profit making purposes:

- capital access account: means an account created by the corporation for the purposes of the capital access program. See Indiana Code 5-28-29-4
- capital asset: means a building, a fixture, a structure, an improvement, or land. See Indiana Code 5-13-9.3-1
- Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
- center: refers to the permit assistance center established by section 4 of this chapter. See Indiana Code 5-28-13-1
- center: refers to the broadband ready communities development center established by section 5 of this chapter. See Indiana Code 5-28-28.5-1
- central region: means the region of the state consisting of Boone County, Clay County, Clinton County, Delaware County, Fayette County, Fountain County, Franklin County, Hamilton County, Hancock County, Hendricks County, Henry County, Johnson County, Madison County, Marion County, Montgomery County, Morgan County, Owen County, Parke County, Putnam County, Randolph County, Rush County, Shelby County, Tippecanoe County, Tipton County, Union County, Vermillion County, Vigo County, Warren County, and Wayne County. - certified technology park: refers to a certified technology park that is:

- Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
- Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
- Civil taxing unit: means any taxing unit except a school corporation. See Indiana Code 6-1.1-18.5-1
- claim: means a claim filed by the lender under section 29 of this chapter. See Indiana Code 5-28-29-5
- clerk: has the meaning set forth in IC 36-1-2-4. See Indiana Code 5-16-11-1
- Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
- commission: refers to the commission for higher education of the state of Indiana established by IC 21-18-2. See Indiana Code 5-14-3.6-1
- commission: refers to the county commission of public records created by section 1 of this chapter. See Indiana Code 5-15-6-1.2
- commission: refers to the integrated public safety commission established under IC 5-26-2-1. See Indiana Code 5-26-1-1
- commissioner: refers to the commissioner of the department. See Indiana Code 5-22-21-2
- common construction wage statute: refers to the following:

- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- communications system infrastructure: means all or part of the infrastructure of the system described in IC 5-26-3, including:

- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.

- Construction manager: means a person designated as a construction manager by contract who provides professional management services, which contribute to the control of time and the cost and quality of a public construction project, and who performs those services concurrent with architectural and engineering services rendered during the design and construction phases of a construction project. - consultant: means an individual who, under a contract with the state or a political subdivision, does either of the following for the state or the political subdivision:

- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- contracting agency: refers to the agency, board, commission, officer, or trustee that enters into a public works contract covered by this article. See Indiana Code 5-16-12.2-1
- Contractor: shall mean any person, firm, limited liability company, or corporation who is party to a contract with a state agency to construct, erect, alter or repair any public building or is any way involved in public work or public improvement. See Indiana Code 5-16-5.5-1
- conveyance: means any transfer of a real property interest for valuable consideration. See Indiana Code 6-1.1-5.5-1

- Conviction: A judgement of guilt against a criminal defendant.

- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- data owner: means a governmental entity that creates or gathers data from other sources and stores that data for its governmental purposes. See Indiana Code 5-14-3.3-1
- Decedent: A deceased person.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- definite situs: means a permanent location in one (1) taxing district or a customary location for use in one (1) taxing district. See Indiana Code 6-1.1-8-2
- delinquent political subdivision: means a political subdivision offering an employee retirement plan described in section 3(b) of this chapter that:

- Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. - Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. - Escrow: Money given to a third party to be held for payment until certain conditions are met.

- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Ex officio: Literally, by virtue of one's office.
- Executive session: A portion of the Senate's daily session in which it considers executive business.
- executive state agency: refers to any agency, authority, board, bureau, commission, department, division, office, or other unit of state government in the executive, including the administrative, department of state government established by any of the following:

- Executor: A male person named in a will to carry out the decedent
- exemption ordinance: refers to an ordinance adopted under section 5 of this chapter by a local income tax council. See Indiana Code 6-1.1-10.3-3
- exemption ordinance: refers to an ordinance adopted under section 6 of this chapter by a county fiscal body. See Indiana Code 6-1.1-10.5-3
- express company: means a company which is engaged in the business of transporting property by land, air, or water, and which does not itself operate the vehicles (except for terminal pickup and delivery vehicles) of transportation. See Indiana Code 6-1.1-8-2
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- families: has the meaning set forth in Indiana Code 5-20-4-2

- Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
- federal income poverty level: means the nonfarm income official poverty line as determined annually by the federal Office of Management and Budget. See Indiana Code 5-28-18-1
- federal program: means a federal loan or grant program that promotes economic development. See Indiana Code 5-28-8-2
- Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
- Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
- Fiduciary: A trustee, executor, or administrator.
- filing date: refers to the day in a year on which a personal property tax return is due for a particular assessment date in that year (disregarding any extension period that may be granted for the filing of the return and any period in which an amended return may be filed). See Indiana Code 6-1.1-3-1.5
- filter strip: refers to a strip or an area of vegetation for removing sediment, organic matter and other pollutants from runoff and wastewater. See Indiana Code 6-1.1-6.7-1
- financial institution: has the meaning set forth in Section 14 of the Iran Sanctions Act of 1996 (Public Law 104-172, Indiana Code 5-22-16.5-4
- fiscal body: has the meaning set forth in IC 36-1-2-6. See Indiana Code 5-16-11-4
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
