Terms Used In Indiana Code > Title 4 > Article 3 - Governor
- account: refers to an individual development account. See Indiana Code 4-4-28-1
- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- after care: means assistance provided by a lay caregiver to a patient in the patient's residence under an at home care plan following the patient's discharge from a hospital. See Indiana Code 16-21-12-1
- agency: refers to the legislative services agency established by Indiana Code 2-2.2-4-1
- Agency: means any executive or administrative department, commission, council, board, bureau, division, service, office, officer, administration, or other establishment in the executive or administrative branch of the state government not provided for by the constitution. See Indiana Code 4-3-6-2
- Agency of the state: means any officer, agency, department, board, bureau, commission, division or institution of the state of Indiana, the trustees or board of directors of any corporation of the state or body politic of the state supported in whole or in part by appropriations from the state, and the trustees of any state-supported university. See Indiana Code 4-3-9-1
- Allegation: something that someone says happened.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- animal care facility: refers to an animal care facility (as defined in IC 6-9-39-1) that has companion animals that are available for adoption. See Indiana Code 15-20-4-1
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- applicable federal program: refers to the federal human resource programs for which the cabinet has authority to make recommendations as listed in section 4 of this chapter. See Indiana Code 4-3-27-1
- applicant: means a person that applies for a construction permit under this chapter. See Indiana Code 16-19-3.5-1
- applicant: means a nonprofit organization that:

- application: means an application for a construction permit and any supporting plans and specifications. See Indiana Code 16-19-3.5-2
- Appraisal: A determination of property value.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Arrest: Taking physical custody of a person by lawful authority.
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- at home care plan: means any plan that serves to describe the after care needs of a patient upon discharge from a hospital to the patient's residence, if the at home care plan:

- Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
- authority: refers to the Indiana housing and community development authority established under IC 5-20-1. See Indiana Code 4-4-28-1.5
- authority: means the hospital association created by section 2 of this chapter. See Indiana Code 16-22-6-1
- authority: means the hospital association created by section 5 of this chapter. See Indiana Code 16-22-7-1
- Babcock test: means the official Babcock test for milk and for cream. See Indiana Code 15-18-2-1
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Bequest: Property gifted by will.
- board: refers to the board of directors of the corporation. See Indiana Code 4-3-17-1
- board: refers to the creamery examining board established by section 9 of this chapter. See Indiana Code 15-18-2-2
- board: refers to the Indiana dairy industry development board established by section 9 of this chapter. See Indiana Code 15-18-5-1
- board: refers to the Indiana standardbred advisory board established by section 2 of this chapter. See Indiana Code 15-19-2-1
- board: refers to the Indiana state board of animal health established by IC 15-17-3-1. See Indiana Code 15-19-6-2
- board: refers to the board of a municipal corporation created under this chapter. See Indiana Code 16-22-8-2.1
- bond bank: means the local public improvement bond bank established pursuant to Indiana Code 16-22-8-2.3
- brand: means a distinctive design or mark of identification made or applied to the hide on livestock by the use of a hot iron or by any other method or process approved by the board. See Indiana Code 15-19-6-3
- brand name: means a word, name, symbol, or device or any combination of words, names, symbols, graphics, or devices that identifies the commercial feed of a distributor and distinguishes it from that of other distributors. See Indiana Code 15-19-7-1
- budget agency: means the budget agency created by IC 4-12-1-3. See Indiana Code 4-3-24-1
- building authority: means the building authority established pursuant to IC 36-9-13 by the county in which the corporation is established. See Indiana Code 16-22-8-2.5
- cabinet: refers to the governor's workforce cabinet established by section 3 of this chapter. See Indiana Code 4-3-27-2
- center: refers to the commercial solar and wind energy ready communities development center that may be established under section 12 of this chapter. See Indiana Code 4-3-23.1-1
- center: refers to the state health data center established by this chapter. See Indiana Code 16-19-10-1
- Chambers: A judge's office.
- Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
- checklist: refers to a food service establishment inspection report checklist form prepared by the state department. See Indiana Code 16-20-8-1
- city health department: means a city health department in a second class city. See Indiana Code 16-20-4-2
- Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
- client: means an individual who has been accepted to receive personal services from a personal services agency. See Indiana Code 16-27-4-1
- commercial feed: means all materials, or combinations of materials, that are distributed or intended for distribution for use as feed or for mixing in feed, except as exempted in this section. See Indiana Code 15-19-7-2
- commercial solar project: means a project involving the construction, installation, siting, modification, operation, or decommissioning of one (1) or more commercial solar energy systems (as defined in IC 8-1-42-2) in a unit. See Indiana Code 4-3-23.1-2
- commercial solar regulation: has the meaning set forth in IC 8-1-42-3. See Indiana Code 4-3-23.1-3
- commercial use: means sale for:

- commission: refers to the Indiana commission to combat substance use disorder established by section 3 of this chapter. See Indiana Code 4-3-25-1
- committee: refers to the hospital assessment fee committee established by section 7 of this chapter. See Indiana Code 16-21-10-1
- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- community based organization: means a private, nonprofit corporation whose board of directors is comprised of business, civic, and community leaders, and whose principal purpose includes the provision of low income housing. See Indiana Code 4-4-28-1.7
- community based palliative care: means patient centered and family focused palliative care that is provided in a location that the patient considers to be the patient's home. See Indiana Code 16-25-4.7-1
- community benefits: means the unreimbursed cost to a hospital of providing charity care, government sponsored indigent health care, donations, education, government sponsored program services, research, and subsidized health services. See Indiana Code 16-21-9-1
- community development corporation: means a private, nonprofit corporation:

- companion animal: means a dog or a cat. See Indiana Code 15-20-4-2
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- comprehensive care bed: means a bed that:

- comprehensive care health facility: means a health facility that provides:

- Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
- Continuance: Putting off of a hearing ot trial until a later time.
- continuing care retirement community: means a health care facility that:

- continuous process improvement: means a management methodology that combines tools to improve process speed and reduce waste with data driven project analysis to provide products and services with improved quality at lower cost. See Indiana Code 4-3-26-1
- Contract: A legal written agreement that becomes binding when signed.
- contracting county: means a county that contracts with a county having a hospital for the care of patients. See Indiana Code 16-24-2-2
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- corporation: refers to the Hoosier alliance against drugs established under this chapter. See Indiana Code 4-3-17-2
- customer formula feed: means commercial feed that consists of a mixture of commercial feeds or feed ingredients, each batch of which is mixed to meet the request of the final purchaser that the mixture contain a specific content of ingredients, nutrients, or nonnutritive additives. See Indiana Code 15-19-7-3
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- department: refers to the department of homeland security established under IC 10-19-2-1. See Indiana Code 16-19-3.5-2.5
- Dependent: A person dependent for support upon another.
- deployed: means , with respect to the availability of minimum broadband Internet at a location, that an eligible broadband service provider:

- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Devise: To gift property by will.
- director: means the director of the office of management and budget established by this chapter. See Indiana Code 4-3-22-2
- director: means the director of the office. See Indiana Code 4-3-23-1
- director: refers to the director of the Indiana state department of agriculture or the director's designee. See Indiana Code 15-18-5-3
- director: refers to the director of the office. See Indiana Code 16-19-14-1
- discharge: means a patient's exit or release from a hospital following an inpatient hospitalization. See Indiana Code 16-21-12-3
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- distribute: means to:

- division: refers to the division of historic preservation and archeology of the department of natural resources established by IC 14-9-4-1. See Indiana Code 4-4-37-1.3
- division: means an administrative subdivision created by this chapter or by the board. See Indiana Code 16-22-8-3
- Donor: The person who makes a gift.

- eligible broadband service: means a connection to the Internet that provides an actual speed of at least:

- engaged in the production of milk: includes every person engaged in producing milk in Indiana or to be shipped into Indiana as a:

- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. - Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Ex officio: Literally, by virtue of one's office.
- executive director: refers to the executive director of the agency employed under Indiana Code 2-2.2-4-2
- executive state agency: refers to any agency, authority, board, bureau, commission, department, division, office, or other unit of state government in the executive, including the administrative, department of state government established by any of the following:

- Executor: A male person named in a will to carry out the decedent
- expanded criminal history check: has the meaning set forth in Indiana Code 16-27-2-0.5
- facility: includes the following:

- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- family: means the individual's spouse, child, parent, parent-in-law, grandparent, grandchild, brother, brother-in-law, sister, sister-in-law, aunt, aunt-in-law, uncle, uncle-in-law, niece, and nephew. See Indiana Code 16-27-4-5
- fee: refers to the hospital assessment fee authorized by this chapter. See Indiana Code 16-21-10-2
- fee period: means the period during which a fee is collected under this chapter. See Indiana Code 16-21-10-3
- Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
- feed ingredient: means each of the constituent materials making up a commercial feed. See Indiana Code 15-19-7-7
- Fiduciary: A trustee, executor, or administrator.
- financial institution: means a bank, savings association, credit union, or any other institution regulated under IC 28 or federal law. See Indiana Code 4-4-28-3
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
- You are late making a payment or commit some other default, triggering an increase to a penalty rate
- The bank changes the terms of your account and you do not reject the change.
- The rate expires (if the rate was fixed for only a certain period of time).
- Fraud: Intentional deception resulting in injury to another.
- fund: refers to the commercial solar and wind energy ready communities incentive fund described in section 16 of this chapter. See Indiana Code 4-3-23.1-4
- fund: refers to an individual development account fund established by a community development corporation or community based organization under section 13 of this chapter. See Indiana Code 4-4-28-4

- general hospital: means an inpatient facility open to the general public that admits any combination of maternity, acute, or long term medical or surgical patients and provides personal care, x-rays, laboratory, surgery, and other recognized hospital specialized diagnostic or treatment facilities and services for the purpose of furnishing inpatient medical or surgical care. - Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- governing body: means the county executive of a county or the legislative and fiscal body of a city. See Indiana Code 16-22-7-2
- government information: refers to any information created, received, maintained, or stored by or otherwise in the control of a governmental entity, regardless of the form or the media on which the information is recorded. See Indiana Code 4-3-26-7
- government sponsored indigent health care: means the unreimbursed cost to a hospital of Medicare, providing health care services to recipients of Medicaid, and other federal, state, or local indigent health care programs, eligibility for which is based on financial need. See Indiana Code 16-21-9-2
- Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
- Grantor: The person who establishes a trust and places property into it.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.

- Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.

- individual development account: means an account in a financial institution administered by a community development corporation or community based organization that allows a qualifying individual to deposit money:

- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- interest in land: means both legal and equitable title and interest in land. See Indiana Code 4-3-9-1
- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- item or service: means any item or service, including service packages, that could be provided by an ambulatory outpatient surgical center to a patient for which the ambulatory outpatient surgical center has established a standard charge. See Indiana Code 16-21-17-0.3
- Joint resolution: A legislative measure which requires the approval of both chambers.
- Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- label: means a display of written, printed, or graphic matter upon or affixed to the container in which a commercial feed is distributed or on the invoice or delivery slip with which a commercial feed is distributed. See Indiana Code 15-19-7-8
- labeling: means all labels and other written, printed, or graphic matter:

- lay caregiver: means an individual who:

- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Lien: A claim against real or personal property in satisfaction of a debt.
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.

- manufacture: means to grind, mix, blend, or further process a commercial feed for distribution. See Indiana Code 15-19-7-10
- medical record: means written or printed information possessed by a provider (as defined in IC 16-18-2-295) concerning any diagnosis, treatment, or prognosis of the patient, unless otherwise defined. See Indiana Code 1-1-4-5
- merger: means any change of ownership, including:

- merger agreement: means an agreement between two (2) or more hospitals for the consolidation by merger or other acquisition or transfer of assets by which ownership or control over substantially all of the stock, assets, or activities of one (1) or more previously licensed and operating hospitals is placed under the control of another licensed hospital or other entity that controls hospitals. - military bases: refers to the following:

- milk: means the lacteal secretion obtained by the milking of one (1) or more cows or other dairy animals, including goats, whether in the original or in any processed form, including cream, buttermilk, and skimmed milk intended for human consumption. See Indiana Code 15-18-3-2
- milk: means any class of milk produced by dairy cows in Indiana. See Indiana Code 15-18-5-4
- milk distributor: means any person or person's agent that purchases market milk or market cream from a bargaining agent or another plant for resale. See Indiana Code 15-18-2-3
- minimum broadband Internet: means a terrestrial connection to the Internet that provides an actual speed of at least one hundred (100) megabits per second downstream and at least twenty (20) megabits per second upstream, regardless of the technology or medium used to provide the connection. - minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
- minority: means an individual identified as any of the following:

- mobile camp: has the meaning set forth in IC 8-9-10-1(a). See Indiana Code 16-19-3-0.5
- Month: means a calendar month, unless otherwise expressed. See Indiana Code 1-1-4-5
- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- motor vehicle: has the meaning set forth in IC 9-13-2-105(a). See Indiana Code 4-4-28-5.5
- MPH: refers to the management performance hub established by section 8 of this chapter. See Indiana Code 4-3-26-3
- narrative report: refers to a food service establishment inspection report narrative form prepared by the state department. See Indiana Code 16-20-8-2
- National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
- national criminal history background check: means the determination provided by the state police department under IC 10-13-3-39(i). See Indiana Code 16-27-2-2.1
- nonprofit hospital: means a hospital that is organized as a nonprofit corporation or a charitable trust under Indiana law or the laws of any other state or country and that is:

- nonresidential onsite sewage system: means all equipment and devices necessary for proper conduction, collection, storage, treatment, and onsite disposal of sewage from a building other than a single family or two-family dwelling. See Indiana Code 16-19-3.5-3.5
- nursing facility: means a health facility that is certified for participation in the federal Medicaid program under Title XIX of the federal Social Security Act (Indiana Code 16-28-15-4
- Oath: A promise to tell the truth.
- Oath: includes "affirmation" and "to swear" includes to "affirm". See Indiana Code 1-1-4-5
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- office: refers to the office of legislative ethics established by section 5 of this chapter. See Indiana Code 2-2.2-4-4
- office: refers to the Indiana office of energy development established by section 3 of this chapter. See Indiana Code 4-3-23-2
- office: refers to the Indiana office of energy development established by IC 4-3-23-3. See Indiana Code 4-3-23.1-5

- Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
