  • anatomic pathology service: means any of the following performed by a physician or under the supervision of a physician on a sample taken from a human body:

  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • council: refers to the rare disease advisory council established by section 2 of this chapter. See Indiana Code 16-46-17-1
  • department: refers to the state personnel department. See Indiana Code 16-47-1-1
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Fair Credit Reporting Act: A federal law, established in 1971 and revised in 1997, that gives consumers the right to see their credit records and correct any mistakes. Source: OCC
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fraud: Intentional deception resulting in injury to another.
  • grant program: refers to the prevention and addressing of health issues and challenges grant program established by section 3 of this chapter. See Indiana Code 16-46-16.5-1
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • health benefit plan: refers to the following:

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • person: means an individual, employer, employer association, nonprofit organization, for-profit organization, unit (as defined in IC 36-1-2-23), school corporation, charter school, accredited nonpublic school, research institution, health insurance plan, health insurance ministry, or any combination of these. See Indiana Code 16-46-16.5-2
  • person: means an individual, employer, employer association, nonprofit organization, for-profit organization, institution of higher education, health insurance plan, health ministry, or any combination of these. See Indiana Code 16-46-16.7-2
  • physician: includes a physician group practice. See Indiana Code 16-48-1-2
  • program: refers to the aggregate prescription drug purchasing program established under this chapter. See Indiana Code 16-47-1-3
  • provider: means a health care provider or a clinical laboratory. See Indiana Code 16-48-1-3
  • Quorum: The number of legislators that must be present to do business.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • second opinion: means consultation, histologic processing, or additional testing performed on a sample by a second provider after an anatomic pathology service is performed on the sample by a first provider. See Indiana Code 16-48-1-4
  • Subpoena: A command to a witness to appear and give testimony.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • unit: refers to the identity theft unit established under section 2 of this chapter. See Indiana Code 4-6-13-1
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • Year: means a calendar year, unless otherwise expressed. See Indiana Code 1-1-4-5
