1. To the extent funding is available, the commission shall perform the following duties:
a. Advise the department on the administration of the overall state disability services system.
b. Pursuant to recommendations made for this purpose by the director, adopt necessary rules pursuant to chapter 17A which relate to disability programs and services, including but not limited to definitions of each disability included within the term “disability services” as necessary for purposes of state, county, and regional planning, programs, and services.
c. Adopt standards for community mental health centers, services, and programs as recommended under section 230A.110. The department shall determine whether to grant, deny, or revoke the accreditation of the centers, services, and programs.
d. Adopt standards for the provision under the medical assistance program of individual case management services.
e. Unless another governmental body sets standards for a service available to persons with disabilities, adopt state standards for that service. The commission shall review the licensing standards used by the department or the department of inspections, appeals, and licensing for those facilities providing disability services.
f. Assure that proper reconsideration and appeal procedures are available to persons aggrieved by decisions, actions, or circumstances relating to accreditation.
g. Adopt necessary rules for awarding grants from the state and federal government as well as other moneys that become available to the department for grant purposes.
h. Annually submit to the governor and the general assembly:
(1) A report concerning the activities of the commission.
(2) Recommendations formulated by the commission for changes in law.
i. By January 1 of each odd-numbered year, submit to the governor and the general assembly an evaluation of:
(1) The extent to which services to persons with disabilities are actually available to persons in each county and mental health and disability services region in the state and the quality of those services.
(2) The effectiveness of the services being provided by disability service providers in this state and by each of the state mental health institutes established under chapter 226 and by each of the state resource centers established under chapter 222.
j. Advise the director, the council, the governor, and the general assembly on budgets and appropriations concerning disability services.
k. Coordinate activities with the Iowa developmental disabilities council and the mental health planning council, created pursuant to federal law. The commission shall work with other state agencies on coordinating, collaborating, and communicating concerning activities involving persons with disabilities.
l. Pursuant to a recommendation made by the department, identify basic financial eligibility standards for the disability services provided by a mental health and disability services region. The initial standards shall be as specified in this chapter.
m. Identify disability services outcomes and indicators to support the ability of eligible persons with a disability to live, learn, work, and recreate in communities of the persons’ choice. The identification duty includes but is not limited to responsibility for identifying, collecting, and analyzing data as necessary to issue reports on outcomes and indicators at the county, region, and state levels.
Terms Used In Iowa Code 225C.6
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- children: means a person or persons under eighteen years of age. See Iowa Code 225C.2
- Commission: means the mental health and disability services commission. See Iowa Code 225C.2
- Council: means the council on health and human services. See Iowa Code 225C.2
- Department: means the department of health and human services. See Iowa Code 249L.2
- Department: means the department of health and human services. See Iowa Code 225C.2
- Director: means the director of health and human services. See Iowa Code 225C.2
- Disability services: means services and other support available to a person with mental illness, an intellectual disability or other developmental disability, or brain injury. See Iowa Code 225C.2
- following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
- licensed health care professional: means a person licensed under chapter 148 to practice medicine and surgery or osteopathic medicine and surgery, an advanced registered nurse practitioner licensed under chapter 152 or 152E, or a physician assistant licensed under chapter 148C. See Iowa Code 225C.6
- Mental health and disability services region: means a mental health and disability services region formed in accordance with section 225C. See Iowa Code 225C.2
- mental health professional: means the same as defined in section 228. See Iowa Code 225C.6
- person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
- state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
- subacute mental health services: means all of the following:(1) A comprehensive set of wraparound services for persons who have had or are at imminent risk of having acute or crisis mental health symptoms that do not permit the persons to remain in or threatens removal of the persons from their home and community, but who have been determined by a mental health professional and a licensed health care professional, subject to the professional's scope of practice, not to need inpatient acute hospital services. See Iowa Code 225C.6
- year: means twelve consecutive months. See Iowa Code 4.1
2. Notwithstanding section 217.3, the commission may adopt the rules authorized by subsection 1, pursuant to chapter 17A, without prior review and approval of those rules by the council.3. If the executive branch creates a committee, task force, council, or other advisory body to consider disability services policy or program options involving children or adult consumers, the commission is designated to receive and consider any report, findings, recommendations, or other work product issued by such body. The commission may address the report, findings, recommendations, or other work product in fulfilling the commission’s functions and to advise the department, council, governor, and general assembly concerning disability services.4. a. The department shall coordinate with the department of inspections, appeals, and licensing in the establishment of facility-based and community-based, subacute mental health services.b. A person shall not provide community-based, subacute mental health services unless the person has been accredited to provide the services. The commission shall adopt standards for subacute mental health services and for accreditation of providers of community-based, subacute mental health services.c. As used in this subsection, “subacute mental health services” means all of the following:(1) A comprehensive set of wraparound services for persons who have had or are at imminent risk of having acute or crisis mental health symptoms that do not permit the persons to remain in or threatens removal of the persons from their home and community, but who have been determined by a mental health professional and a licensed health care professional, subject to the professional’s scope of practice, not to need inpatient acute hospital services. For the purposes of this subparagraph, “mental health professional” means the same as defined in section 228.1 and “licensed health care professional” means a person licensed under chapter 148 to practice medicine and surgery or osteopathic medicine and surgery, an advanced registered nurse practitioner licensed under chapter 152 or 152E, or a physician assistant licensed under chapter 148C.(2) Intensive, recovery-oriented treatment and monitoring of the person with direct or remote access to a psychiatrist or advanced registered nurse practitioner.(3) An outcome-focused, interdisciplinary approach designed to return the person to living successfully in the community.(4) Services that may be provided in a wide array of settings ranging from the person’s home to a facility providing subacute mental health services.(5) Services that are time limited to not more than ten days or another time period determined in accordance with rules adopted for this purpose.d. Subacute mental health services and the standards for the services shall be established in a manner that allows for accessing federal Medicaid funding.
