1. Any person with concerns regarding the operations or service delivery of an assisted living program may file a complaint with the department. The name of the person who files a complaint with the department and any personal identifying information of the person or any tenant identified in the complaint shall be kept confidential and shall not be subject to discovery, subpoena, or other means of legal compulsion for its release to a person other than department employees involved with the complaint.

Terms Used In Iowa Code 231C.7

  • Assisted living: includes the provision of housing and assistance with instrumental activities of daily living only if personal care or health-related care is also included. See Iowa Code 231C.2
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Department: means the department of health and human services. See Iowa Code 249L.2
  • Department: means the department of inspections, appeals, and licensing or the department's designee. See Iowa Code 231C.2
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • program: means an entity that provides assisted living. See Iowa Code 231C.2
  • Subpoena: A command to a witness to appear and give testimony.
  • Tenant: means an individual who receives assisted living services through a certified assisted living program. See Iowa Code 231C.2
 2. The department shall establish procedures for the disposition of complaints received in accordance with this section.
