Terms Used In Kansas Statutes 65-5301
- Asbestos: means that asbestiform varieties of: Chrysotile, crocidolite, amosite, anthophyllite, tremolite and actinolite. See Kansas Statutes 65-5301
- Asbestos project: means an activity undertaken to remove or encapsulate friable asbestos containing materials. See Kansas Statutes 65-5301
- Business entity: means a partnership, firm, association, corporation, sole proprietorship or other business concern. See Kansas Statutes 65-5301
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Secretary: means the secretary of health and environment. See Kansas Statutes 65-5301
As used in this act:
(a) “Asbestos project” means an activity undertaken to remove or encapsulate friable asbestos containing materials.
(b) “Business entity” means a partnership, firm, association, corporation, sole proprietorship or other business concern.
(c) “License” means an authorization issued by the secretary permitting a business entity to engage in an asbestos project.
(d) “Secretary” means the secretary of health and environment.
(e) “Friable asbestos containing material” means any material that contains more than 1% asbestos, by weight, which is applied to ceilings, walls, structural members, piping, ductwork or any other part of a building and which, when dry, may be crumbled, pulverized or reduced to powder by hand pressure.
(f) “Asbestos” means that asbestiform varieties of: Chrysotile, crocidolite, amosite, anthophyllite, tremolite and actinolite.
