Terms Used In Kansas Statutes 74-7321

  • Board: means the crime victims compensation board established under Kan. See Kansas Statutes 74-7301
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Victim: means a person who suffers personal injury or death as a result of:

    (1) Criminally injurious conduct;

    (2) the good faith effort of any person to prevent criminally injurious conduct;

    (3) the good faith effort of any person to apprehend a person suspected of engaging in criminally injurious conduct; or

    (4) witnessing a violent crime when the person was 16 years of age or younger at the time the crime was committed. See Kansas Statutes 74-7301

(a) When moneys are to be distributed pursuant to subsection (b) of Kan. Stat. Ann. § 74-7320, and amendments thereto, the victim of the crime, and the victim’s dependents, heirs, representatives or assignees, may apply to the crime victims compensation board for compensation for losses arising from the convicted person’s crime. To the extent that moneys received by the board pursuant to Kan. Stat. Ann. § 74-7319, and amendments thereto, are sufficient, such compensation shall be in an amount equal to the applicant’s actual loss, as determined by the board, less any restitution paid pursuant to order of a court or order of the prisoner review board and any compensation paid by the crime victims compensation board pursuant to Kan. Stat. Ann. § 74-7301 et seq., and amendments thereto. If moneys received by the board pursuant to Kan. Stat. Ann. § 74-7319, and amendments thereto, are not sufficient to pay compensation as otherwise provided under this subsection (a), such moneys shall be prorated among all applicants eligible to receive compensation for losses arising from the convicted person’s crime on the basis that the amount each applicant is entitled to receive under this subsection (a) bears to the total amount all such applicants would be entitled to receive under this subsection (a).

(b) The limitations provided by Kan. Stat. Ann. § 74-7301 et seq., and amendments thereto, shall not apply to compensation paid pursuant to this section.

(c) The crime victims compensation board shall adopt such rules and regulations as necessary to administer the provisions of Kan. Stat. Ann. §§ 74-7319, 74-7320 and 74-7321, and amendments thereto.
