The Cabinet for Health and Family Services shall place a substance in Schedule I if it finds that the substance:
(1) Has high potential for abuse; and

Terms Used In Kentucky Statutes 218A.040

  • Cabinet: means the Cabinet for Health and Family Services. See Kentucky Statutes 218A.010
  • Treatment: when used in a criminal justice context, means targeted interventions
    that focus on criminal risk factors in order to reduce the likelihood of criminal behavior. See Kentucky Statutes 446.010

(2) Has no accepted medical use in treatment in the United States or lacks accepted safety for use in treatment under medical supervision.
