Kentucky Statutes 77.275 – Continuation of variances granted by prior ordinance

If any local ordinance has provided regulations similar to those in KRS § 77.150 to KRS § 77.175 or to any order, regulation, or rule prescribed by the air pollution control board, and has provided for the granting of variances, and pursuant to the local ordinance a variance has been granted prior to the adoption of a resolution by the fiscal court and the passage of an ordinance by the legislative body, pursuant to KRS § 77.010 to KRS § 77.060, or the passage of an ordinance by the consolidated local government, the variance shall be continued as a variance of the hearing board for the time specified therein or one (1) year, whichever is shorter, or until and unless prior to the expiration of such time the hearing board modifies or revokes such variance as provided in KRS § 77.245 to KRS § 77.275.
