The racing commission may require the production of reports or the surrender of sums represented by unclaimed pari-mutuel tickets as provided in KRS § 230.361 to KRS § 230.373 by civil equity action, including, but not limited to, an action in the nature of a bill of discovery, in which case the defendant shall pay a penalty equal to ten percent (10%) of all amounts that he is ultimately required to surrender. The racing commission shall follow the procedures provided by the Rules of Civil Procedure.

- Action: includes all proceedings in any court of this state. See Kentucky Statutes 446.010
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Racing commission: means the Kentucky Horse Racing Commission. See Kentucky Statutes 230.210
